8 Appeal Committee The 47th Report from the Appeal Committee was made; the Appeal Committee reported that they had met and had heard Counsel; the report was agreed to and the following Orders were made:
Her Majesty’s Revenue and Customs (Petitioners) v Loyalty Management UK Limited (Respondents) That leave to appeal be given in order to facilitate a reference to the European Court of Justice; and that the petition of appeal be lodged by 17 April.
Her Majesty’s Revenue and Customs (Respondents) v Total UK Limited (Petitioners) That leave to appeal be refused; and that the petitioners do pay to the respondents the costs of the petition, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties.
