It was ordered and adjudged that the Order of the Queen’s Bench Division of Her Majesty’s High Court of Justice in Northern Ireland of 6 December 2005 be affirmed and the appeal dismissed; that the certified questions be left unanswered; and that the costs of the appellant in this House be taxed in accordance with the provisions of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981.
