Earl Baldwin of Bewdley to ask Her Majesty’s Government, further to the Written Answer by Lord Darzi of Denham on 1 October (WA 145) and in the light of the response to the report of the United States National Research Council in March 2006 on the potential risks of water fluoridation at 4 parts per million (ppm), whether the findings of the report have relevance for areas fluoridated at 1 ppm in view both of the wide variations in individual human response and of the Council’s finding that infants and young children are three to four times as susceptible to fluoride as adults. HL8

Earl Baldwin of Bewdley to ask Her Majesty’s Government, further to the Written Answer by Lord Darzi of Denham on 1 October (WA 145-6), whether they will now address the possibility that infants and young children may suffer a range of adverse effects through water fluoridated at 1 part per million (ppm), in the light of the finding by the United States National Research Council in 2006 that these effects are similar to those for adults at 4 ppm for which the Council found evidence of potential harm to bone strength, IQ, brain chemistry and function and thyroid and other endocrine functions. HL9

Earl Baldwin of Bewdley to ask Her Majesty’s Government, further to the Written Answer by Lord Darzi of Denham on 1 October (WA 145-6), why they now believe that the findings of the United States National Research Council (NRC) in March 2006 are “not directly applicable” to water fluoridation in the United Kingdom because of the differing concentrations of fluoride involved, when as indicated by the Written Answer by Lord Warner on 24 July 2006 (WA 240) they had delayed their own research programme in order to take account of the NRC’s findings in the knowledge that the Council were addressing fluoridation at the higher concentration of 4 parts per million. HL10

Lord Stoddart of Swindon to ask Her Majesty’s Government whether they will ensure that a full official consolidated text of the European Union Reform Treaty signed in Lisbon showing all changes to previous treaties in readable form is made available before the ratification process begins in Parliament. HL11

Lord Stoddart of Swindon to ask Her Majesty’s Government what assessment they have made of the statement by the President of the European Commission, Mr José Barroso, on the Radio 4 Today programme on 20 October that “the [British] red lines are secure for the time being”. HL12

Lord Stoddart of Swindon to ask Her Majesty’s Government whether they will explain the methods the Prime Minister will adopt to deliver his promise not to support further European Union institutional changes over the next four years in the light of a statement of the Prime Minister of Portugal, Mr José Sócrates, commenting on the European Union Reform Treaty that “this Treaty is not the end of the story because there is no end”. Lord Avebury to ask Her Majesty’s Government whether, having regard to the Chinese Nationality Law promulgated by the Chairman of the Standing Committee of the National People’s Congress on 10 September 1980 and the clarifications concerning implementation of Chinese Nationality Law in Hong Kong, adopted on 15 May 1996, a person who is a British National (Overseas) and is of Chinese ethnicity or race would be entitled to registration under section 1 of the British Nationality (Hong Kong) Act 1997 under the following circumstances—

(a) he was born in Hong Kong;

(b) he does not satisfy the criteria to be a Chinese national set out in Article 4 or 6 of the Chinese Nationality Law because (i) neither of his parents have every held Chinese nationality, and (ii) neither of his parents was stateless;

(c) he has never been naturalised as a Chinese citizen;

(d) he is ordinarily resident in Hong Kong at the time of the application for registration;

(e) immediately before 4 February 1997 he (i) was ordinarily resident in Hong Kong; (ii) was a British Dependent Territories citizen by virtue only of his having a connection with Hong Kong (within the meaning given by the Schedule to the 1997 Act); and (iii) held no other nationality other than British National (Overseas);

(f) since 4 February 1997 he has held no nationality or citizenship other than as set out above; and

(g) he satisfies the requirements of section 58 of the Immigration, Asylum and Nationality Act 2006. HL99

Lord Avebury to ask Her Majesty’s Government under what circumstances the Civil Procedure Rules allow the Treasury Solicitor to ask for an extension of time to file an Acknowledgement of Service at the Permission Stage of a Judicial Review if both parties agree to the extension; and after how many days the Court will proceed to make a decision on the Permission Application notwithstanding that the Defendant has failed to file an Acknowledgement of Service. The House met at 11.30am

1   Queen’s Speech The Queen being seated on the Throne, and the Commons being at the Bar with their Speaker, Her Majesty was pleased to make a Most Gracious Speech to both Houses of Parliament, and then retired.

The House adjourned. The House resumed at 3.30pm.

Prayers were read by the Lord Bishop of Coventry.

2   Clerk of the Parliaments The House having been informed on 24 May that Her Majesty had been pleased to appoint Mr Michael Graham Pownall to the office of Clerk of the Parliaments, vacant by the retirement of Sir Paul David Grenville Hayter, KCB, LVO, the letters of appointment dated 4 November were read; then the said Michael Graham Pownall made the prescribed declaration (which declaration is set down in the Roll amongst the Oaths of the Great Officers), and took his seat at the Table.

3   Members of the House It was ordered that a list of members of the House, prepared by the Clerk of the Parliaments, be printed. (HL Paper 1)

4   Select Vestries Bill The Bill was presented by the Lord President (Baroness Ashton of Upholland) and read a first time pro forma.

5   Queen’s Speech The Lord Speaker reported the Queen’s Speech. Baroness Corston moved that a Humble Address be presented to Her Majesty as follows:

“Most Gracious Sovereign,

We, Your Majesty’s most dutiful and loyal subjects, the Lords Spiritual and Temporal in Parliament assembled, beg leave to thank Your Majesty for the most gracious Speech which Your Majesty has addressed to both Houses of Parliament.”

The motion was seconded by Lord Hart of Chilton, and the debate was adjourned till tomorrow.

6   Chairman of Committees Lord Brabazon of Tara was appointed to take the Chair in all Committees for this Session nemine dissentiente.

7   Principal Deputy Chairman of Committees Lord Grenfell was appointed Principal Deputy Chairman of Committees for this Session nemine dissentiente.

8   Stoppages in the Streets It was ordered that the Commissioner of Police of the Metropolis do take care that the passages through the streets leading to this House be kept free and open and that no obstruction be permitted to hinder the passage of Lords to and from this House during the sitting of Parliament; or to hinder Lords in the pursuit of their Parliamentary duties on the Parliamentary Estate; and that the Gentleman Usher of the Black Rod attending this House do communicate this Order to the Commissioner.

9   Hereditary peers: by-elections The Clerk of the Parliaments laid before the House, in accordance with Standing Order 10(5), a register of hereditary peers (other than peers of Ireland) who wish to stand in any by-election for membership of the House held in accordance with section 2(4) of the House of Lords Act 1999; it was ordered that the register be printed.
