MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Peterborough.

1.  Lord Bishop of Ripon and Leeds—John Richard Lord Bishop of Ripon and Leeds was introduced between the Lord Bishop of Peterborough and the Lord Bishop of Newcastle; and took and subscribed the oath pursuant to statute.

2.  Lord Harris of High Cross—The Lord Speaker acquainted the House that Lord Harris of High Cross, a member of the House, had died on 19th October 2006.

Judicial Business

3.  R v. Davis (Appellant) (On Appeal from the Court of Appeal (Criminal Division))—The appeal of Iain Davis was presented and ordered to be prosecuted subject to the procedures applicable thereto.

4.  Confiscation Unit, Organised Crime Division (Respondents) v. McKinsley (FC) (Petitioner)—The petition of James McKinsley praying for leave to appeal was presented and referred to an Appeal Committee. The petitioner’s certificate of public funding was lodged.

5.  R (on the application of M) (Respondent) v. Slough Borough Council (Respondents) and another (Petitioner)—The petition of the Secretary of State for the Home Department praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.

6.  Gotham (as trustee in bankruptcy of Kevin Leonard Doodes) (Respondent) v. Doodes (Petitioner)—The petition of Kevin Leonard Doodes praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.

7.  In re F (children) (2006)—The petition of the Mother praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented without payment of the fee, such fee having been waived by the Appeal Committee pursuant to Standing Order XIII; the said petition was referred to an Appeal Committee.

8.  Grieves (Appellant) v. F T Everard & Sons Limited and others (Respondents)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 10th November (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed (lodged 14th October).

11.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

1.  Devon and Somerset Fire and Rescue Authority (Combination Scheme) Order 2006, laid under the Fire and Rescue Services Act 2004;  (2790)

2.  Registration of Births and Deaths (Electronic Communications and Electronic Storage) Order 2006, laid under the Electronic Communications Act 2000.  (2809)

12.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

1.  Report and Accounts for 2005-06 of the UK Film Council and its Lottery Fund, laid under the National Lottery etc. Act 1993;

2.  Report for 2005-06 of The Electoral Commission, laid under the Political Parties, Elections and Referendums Act 2000.

Public Business

13.  Armed Forces Bill—It was moved by the Baroness Crawley, on behalf of the Lord Drayson, that the amendments for the Report stage be marshalled and considered in the following order:

14.  Animal Welfare Bill—The report was received; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; it was ordered that the bill be printed as amended. (HL Bill 156)

15.  Tax credits—The Lord Northbrook asked Her Majesty’s Government whether the operation of the tax credits system is satisfactory; after debate, the question was answered by the Lord McKenzie of Luton.
