MINUTES OF PROCEEDINGS

Wednesday 1st March 2006

The House met at a quarter before ten o’clock.

PRAYERS were read by the Lord Bishop of Newcastle.

1.  Leave of Absence—Leave of absence was granted to the Lord Chancellor for Friday 3rd March.

Judicial Business

2.  Matthews and others (Appellants) v. Kent and Medway Towns Fire Authority and others (Respondents)—It was moved by the Lord Nicholls of Birkenhead, That the 39th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeal be allowed; that the Order of the Court of Appeal of 2nd July 2004, the Order of the Employment Appeal Tribunal of 7th August 2003 and the decision of the Employment Tribunal sitting at London South and entered in the Register on 22nd July 2002 all be set aside; that the determination of the Court of Appeal of 2nd July 2004 to the effect that retained and whole-time fire-fighters are employed under the same type of contract for the purpose of regulation 2(4)(a)(i) of the Part-time Workers (Prevention of Less Favourable Treatment) Regulations 2000 be affirmed; that the case be remitted back to the Employment Tribunal for reconsideration in the light of the opinions expressed in this House of the issue under regulation 2(4)(a)(ii) of the 2000 Regulations of “same or broadly similar work” and any further issues which arise as a result of its conclusion on that; that the respondents do pay or cause to be paid to the appellants their costs in the Court of Appeal and in this House; and that the amount of such costs in the Court of Appeal be determined by a Costs Judge and the amount of such costs in this House be certified by the Clerk of the Parliaments if not agreed between the parties. 3.  Haward and others (Respondents) v. Fawcetts (a firm) (Appellants) and others—It was moved by the Lord Nicholls of Birkenhead, That the 40th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeal be allowed; that the Order of the Court of Appeal of 11th March 2004 be set aside so far as regards the words complained of; that the Order of His Honour Judge Playford QC (sitting as a High Court Judge) in the High Court of Justice Queen’s Bench Division of 15th April 2003 be restored; that the respondents do pay or cause to be paid to the appellants their costs in this House and below; and that the amount of such costs in the Court of Appeal be determined by a Costs Judge and the amount of such costs in this House be certified by the Clerk of the Parliaments if not agreed between the parties. 4.  Director of Public Prosecutions (Petitioner) v. Glendinning (Respondent)—The petition of the Director of Public Prosecutions praying for leave to appeal in accordance with the Administration of Justice Act 1960 was presented and referred to an Appeal Committee.

9.  Statutory Instruments—The 19th Report from the Joint Committee was made on certain statutory instruments, including the following affirmative instruments:

      Draft Films (Definition of “British Film”) Order 2006;

      Draft Guardian’s Allowance Up-rating Order 2006;

      Draft Occupational Pension Schemes (Levies) (Amendment) Regulations 2006;

Private Business

10.  London Local Authorities Bill [HL] [Petition for Additional Provision]—It was reported from the Standing Orders Committee that the Standing Orders not complied with in respect of the petition for additional provision in the bill ought to be dispensed with; the report was agreed to.

Public Business

11.  Government of Wales Bill—A bill to make provision about the government of Wales was brought from the Commons, read a first time and ordered to be printed. (HL Bill 81)

12.  Government of Wales Bill—It was ordered that the Explanatory Notes relating to the bill be printed. (HL Bill 81-EN)

13.  London Olympic Games and Paralympic Games Bill—It was moved by the Lord Grocott, on behalf of the Lord Davies of Oldham, that the amendments for the Report stage be marshalled and considered in the following order:

15.  Council Tax (New Valuation Lists for England) Bill—The report was received; amendments were moved (and by leave of the House) withdrawn.

16.  Health Bill—It was moved by the Lord Warner that the bill be now read a second time; after debate, the motion was agreed to.

The House was adjourned at seventeen minutes before nine o’clock
