HOUSE OF LORDS

MINUTES OF PROCEEDINGS

Monday 30th January 2006

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of St Albans.

1.  Lord Mishcon—The Lord Chancellor acquainted the House that Lord Mishcon, a member of the House, had died on 27th January 2006.

Judicial Business

2.  Hamilton and others (Appellants) v. Allied Domecq plc (Respondents) (Scotland)—The appeal of John Stewart Hamilton and Stebbings Inc was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 13th March.

3.  Taylor (Respondent) v. Rive Droite Music Limited (Petitioners)—The petition of Rive Droite Music Limited praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.

4.  Whaley and another (Appellant) v. Advocate General for Scotland and another and others (Respondents) (Scotland)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 3rd April (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed.

5.  Appeal Committee—The following Order was made pursuant to the 67th Report:

    Belfast City Council (Petitioners) v. Miss Behavin’ Limited (Respondents) (Northern Ireland)—That leave to appeal be given; and that the petition of appeal be lodged by 13th February.

Papers

6.  Command Papers—The following papers, having been presented to the House by command of Her Majesty, were ordered to lie on the Table:

    1.  Transport—Government Response to the Preliminary Report of the House of Commons Transport Committee on UK Transport Security;    (6736)

    2.  Health—Our health, our care, our say: a new direction for community services: Government proposals.    (6737)

7.  Statutory Instrument (Standing Order 71)—The following negative instrument having been laid before the House on 27th January was ordered to lie on the Table:

    Police Act 1996 (Local Policing Summaries) Order 2006, laid under the Police Act 1996.    (122)

8.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.  Accounts for 2004-05 of the Sports Council for Northern Ireland Lottery Distribution, laid under the National Lottery etc. Act 1993, together with the Report of the Comptroller and Auditor General;

    2.  Accounts for 2004-05 of the Probation Board for Northern Ireland, laid under the Probation Board (Northern Ireland) Order 1982, together with the Report of the Comptroller and Auditor General.

Private Business

9.  London Local Authorities Bill [HL]—The petition against the bill from The National Federation of Retail Newsagents (No. 2) was withdrawn.

Public Business

10.  Criminal Defence Service Bill [HL]—The bill was returned from the Commons agreed to with amendments and a privilege amendment; it was ordered that the Commons amendments be printed. (HL Bill 70)

11.  Identity Cards Bill—The bill was further considered on report; amendments were agreed to; amendments were moved and (by leave of the House) withdrawn; an amendment was moved, objected to and on question, the numbers being equal (see division list 1), the amendment was disagreed to pursuant to Standing Order 57; amendments were agreed to (see division lists 2 and 3); an amendment was disagreed to (see division list 4); it was ordered that the bill be printed as amended. 12.  Terrorism (Northern Ireland) Bill—The report was received.

13.  Natural Environment and Rural Communities Bill—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; the House was resumed after amendment 121.

The House was adjourned at ten o’clock

till tomorrow, half-past two o’clock.

APPENDIX

PROCEEDINGS OF THE GRAND COMMITTEE (IN THE MOSES ROOM)

The Committee met at half-past three o’clock.

    Company Law Reform Bill [HL]—The bill was considered in the Grand Committee; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the Committee was adjourned after clause 72 stood part.

The Committee was adjourned at twenty-eight minutes before eight o’clock.

    The following entry should have appeared in the Minutes of Proceedings for Thursday 26th January:

11.  London Local Authorities Bill [HL]—The petition of Westminster City Council for additional provision, together with a list of the amendments proposed to be made, was presented and referred to the Examiners.
