HOUSE OF LORDS

MINUTES OF PROCEEDINGS

Wednesday 25th January 2006

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Manchester.

1.  Lord Archbishop of York—John Tucker Mugabi Lord Archbishop of York was introduced between the Lord Archbishop of Canterbury and the Lord Bishop of Oxford; and took and subscribed the oath pursuant to statute.

Judicial Business

2.  Starritt (Petitioner) v. Police Service of Northern Ireland (Northern Ireland)—The petition of Trevor Iain Starritt praying for leave to appeal was presented and referred to an Appeal Committee (lodged 21st December).

3.  Cartwright (Petitioner) v. Police Service of Northern Ireland (Northern Ireland)—The petition of Charlotte Cartwright praying for leave to appeal was presented and referred to an Appeal Committee.

4.  Her Majesty’s Revenue and Customs (Respondents) v. Stringer and others (Appellants)—The appeal was set down for hearing and referred to an Appellate Committee.

5.  Command Papers—The following papers, having been presented to the House by command of Her Majesty, were ordered to lie on the Table:

    1.  Treaty Series—Third supplementary list of ratifications, accessions, withdrawals, etc., for 2005;    (6729)

    2.  Social Security—Report by the Government Actuary on the drafts of the Social Security Benefits Up-rating Order 2006 and the Social Security (Contributions) (Re-rating and National Insurance Funds Payments) Order 2006.    (6732)

6.  Affirmative Instruments—The following instruments were laid before the House for approval by resolution and ordered to lie on the Table:

    1.  (i)  Draft Social Security Benefits Up-rating Order 2006, together with an Explanatory Memorandum—

      (ii)  Draft Social Security (Contributions) (Re-rating and National Insurance Funds Payments) Order 2006, together with an Explanatory Memorandum—

      laid under the laid under the Social Security Administration Act 1992;

    2.  Draft Guaranteed Minimum Pensions Increase Order 2006, laid under the Pension Schemes Act 1993, together with an Explanatory Memorandum;

    3.  Draft Budget (Northern Ireland) Order 2006, laid under the Northern Ireland Act 2000, together with an Explanatory Memorandum.

7.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.  Serious Organised Crime and Police Act 2005 (Delegation under section 43) Order 2006, laid under the Serious Organised Crime and Police Act 2005;    (100)

    2.  Social Security (Contributions) (Amendment) Regulations 2006, laid under the Social Security Contributions and Benefits Act 1992.    (127)

8.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Report on target setting and performance management in the criminal justice system in Northern Ireland, laid under the Justice (Northern Ireland) Act 2002.

Select Committee Reports

9.  Statutory Instruments—The 15th Report from the Joint Committee was made on certain statutory instruments, including the following affirmative instruments:

      Draft Information and Consultation of Employees (Amendment) Regulations 2006;

      Draft Northern Ireland Arms Decommissioning Act 1997 (Amnesty Period) Order 2006;

      Draft Pension Protection Fund (Risk-based Pension Protection Levy) Regulations 2006;

      Draft Pneumoconiosis etc. (Workers’ Compensation) (Payment of Claims) (Amendment) Regulations 2006;

      Draft School Finance (England) Regulations 2006;

    it was ordered that the Report be printed. (HL Paper 106)

10.  European Union—The 21st Report from the Select Committee, Including the Aviation Sector in the European Union Emissions Trading Scheme, was made and ordered to be printed, together with the Minutes of Evidence. (HL Paper 107)

Public Business

11.  Standing Orders (Public Business)—It was moved by the Lord President (Baroness Amos) that the Standing Orders relating to public business be amended as follows:

    Standing Order 65 (Sessional Committees)

    Leave out Standing Order 65 and insert:

    “65. The orders of appointment of the following Committees and any of their Sub-Committees shall remain in force and effect, notwithstanding the prorogation of Parliament, until such time as the House or Committee makes further orders of appointment in the next succeeding session:

      Administration and Works Committee

      Consolidation Bills Committee

      Constitution Committee

      Delegated Powers and Regulatory Reform Committee

      Economic Affairs Committee

      European Union Committee

12.  London Olympic Games and Paralympic Games Bill—It was moved by the Lord Davies of Oldham that it be an instruction to the Grand Committee to which the London Olympic Games and Paralympic Games Bill has been committed that they consider the bill in the following order:

the motion was agreed to.

1.  13.  Terrorism Bill—The bill was further considered on report; amendments were disagreed to (see division lists 1 and 2); amendments were agreed to; amendments were moved and (by leave of the House) withdrawn; it was ordered that the bill be printed as amended. (HL Bill 69)

14.  Compensation Bill [HL]—The bill was reported from the Grand Committee with amendments; it was ordered that the bill be printed as amended. (HL Bill 68)

15.  Disability Discrimination (Northern Ireland) Order 2005—It was moved by the Lord Rooker that the draft Order laid before the House on 7th December 2005 be approved; after debate, the motion was agreed to.

16.  Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 2006—It was moved by the Lord Evans of Temple Guiting that the draft Order laid before the House on 6th December 2005 be approved; after debate, the motion was agreed to.

17.  Gaelic Language (Scotland) Act 2005 (Consequential Modifications) Order 2006—It was moved by the Lord Evans of Temple Guiting that the draft Order laid before the House on 6th December 2005 be approved; after debate, the motion was agreed to.

18.  Charities and Trustee Investment (Scotland) Act 2005 (Consequential Provisions and Modifications) Order 2006—It was moved by the Lord Evans of Temple Guiting that the draft Order laid before the House on 6th December 2005 be approved; the motion was agreed to.

The House was adjourned at twenty-four minutes before nine o’clock

till tomorrow, a quarter before ten o’clock for judicial business,

eleven o’clock for public business.
