Judicial Business

1.  GE Capital Bank Limited (Respondents) v. Rushton and another (Petitioner)—The petition of Richard Jenking praying for leave to appeal was presented and referred to an Appeal Committee (lodged 16th January).

2.  Jones (Respondent) v. Garnett (Her Majesty’s Inspector of Taxes) (Petitioner)—The petition of Michael Vincent Garnett praying for leave to appeal was presented and referred to an Appeal Committee (lodged 16th January).

3.  Higgins (Respondent) v. Gribben and another (Petitioners) (Northern Ireland)—The petition of Michael Gribben and Bredeen Gribben praying for leave to appeal was presented and referred to an Appeal Committee (lodged 16th January).

4.  R v. Goodwin (Respondent)—The petition of the Crown Prosecution Service praying for leave to appeal in accordance with the Criminal Appeal Act 1968 was presented and referred to an Appeal Committee (lodged 13th January).

5.  Enander (Petitioner) v. Governor of HMP Brixton and others (Respondents)—The petition of John Enander praying for leave to appeal in accordance with the Extradition Act 2003 was presented and referred to an Appeal Committee (lodged 12th January).

6.  West Tankers Inc (Respondents) v. RAS Riunione Adriatica di Sicurta SpA and others (Appellants)—The appeal was set down for hearing and referred to an Appellate Committee.

7.  Ayliffe and others (Appellants) v. Director of Public Prosecutions (Respondent) (Criminal Appeal from Her Majesty’s High Court of Justice)—The appeal was set down for hearing and referred to an Appellate Committee.

8.  Swain (Appellant) v. Director of Public Prosecutions (Respondent) (Criminal Appeal from Her Majesty’s High Court of Justice)—The appeal was set down for hearing and referred to an Appellate Committee.

9.  St Helens Borough Council (Respondents) v. Derbyshire and others (Appellants)—It was ordered that the appellants be allowed to prosecute the appeal without giving the usual security for costs as required by Standing Order (lodged 16th January).

17.  Merits of Statutory Instruments—The following Report from the Select Committee was made and ordered to be printed:

      Draft Artist’s Resale Right Regulations 2006;

      Draft Representation of the People (England and Wales) (Amendment) Regulations 2006;

    and on the following negative instruments:

      Non-Contentious Probate Fees (London Terrorist Bombings) Order 2005;

      Cattle Compensation (England) Order 2005;

      Companies Act 1985 (Operating and Financial Review) (Repeal) Regulations 2005;

      Serious Organised Crime and Police Act 2005 (Designated Sites) Order 2005;

Public Business

19.  Parliament (Participation of Members of the House of Commons) Bill [HL]—A bill to provide for the Speaker of the House of Commons to have power to determine the eligibility of members of the House of Commons to participate in certain legislative proceedings of that House was presented by the Lord Baker of Dorking, read a first time and ordered to be printed. (HL Bill 61)

20.  Constitutional Reform (Prerogative Powers and Civil Service etc.) Bill [HL]—A bill to place under the authority of Parliament executive powers exercisable by Ministers of the Crown by virtue of the Royal prerogative; to make provision relating to the appointment and conduct of, and general duties relating to, civil servants and special advisers; to make provision about nationality requirements for persons employed or holding office in a civil capacity under the Crown; to establish a procedure for the making of certain public appointments; to make provision about access to the Parliamentary Commissioner for Administration; and for connected purposes was presented by the Lord Lester of Herne Hill, read a first time and ordered to be printed. 21.  Equality Bill [HL]—The bill was returned from the Commons with amendments and with a privilege amendment; it was ordered that the Commons amendments be printed. (HL Bill 63)

22.  Terrorism Bill—The report was received; amendments were agreed to; an amendment was disagreed to (see division list 1); amendments were agreed to (see division lists 2 and 3); further consideration on report was adjourned.

23.  Council housing—The Baroness Scott of Needham Market asked Her Majesty’s Government what plans they have for the future of council housing; after debate, the question was answered by the Baroness Andrews.

1.  24.  Terrorism Bill—The bill was further considered on report; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; further consideration on report was adjourned after amendment 63.
