MINUTES OF PROCEEDINGS

Wednesday 11th January 2006

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Exeter.

1.  Oath—Sebastian Newbold Lord Coe took and subscribed the oath pursuant to statute.

Judicial Business

2.  R v. Holding (Respondent)—The petition of the Crown Prosecution Service praying for leave to appeal in accordance with the Criminal Appeal Act 1968 was presented and referred to an Appeal Committee (lodged 4th January).

3.  Appeal Committee—The 73rd Report from the Appeal Committee was agreed to and the following Order was made—

    Hamid (FC) (Appellant) v. Secretary of State for the Home Department (Respondent)—

    Gaafar (FC) (Appellant) v. Secretary of State for the Home Department (Respondent)—

    Mohammed (FC) (Appellant) v. Secretary of State for the Home Department (Respondent)—

    (Consolidated Appeals)—

    That the petition of the Office of the United Nations High Commissioner for Refugees that they might intervene in the said appeals by way of written submissions only be allowed.

Papers

4.  Command Papers—The following papers, having been presented to the House by command of Her Majesty, were ordered to lie on the Table:

    1.  Public Accounts Committee—Northern Ireland Department of Finance and Personnel Memorandum on the 10th and 11th Reports from the Committee of Public Accounts;    (6724)

    2.  Defence—Departmental Minute from the Ministry of Defence concerning the gifting of military equipment to Iraq.    (—)

5.  Affirmative Instrument—The following instrument was laid before the House for approval by resolution and ordered to lie on the Table:

    Draft Pension Protection Fund (Pension Compensation Cap) Order 2006, laid under the Pensions Act 2004, together with an Explanatory Memorandum.

6.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

      (i)  Community Drivers’ Hours and Working Time (Road Tankers) (Temporary Exception) Regulations 2006—  (17)

      (ii)  Performances (Moral Rights, etc.) Regulations 2006—  (18)

      laid under the European Communities Act 1972.

7.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Report for 2003-05 of the Mental Health Act Commission, laid under the Mental Health Act 1983.

8.  Instrument coming into operation before being laid—The Lord Chancellor acquainted the House that he had received, under the proviso to section 4(1) of the Statutory Instruments Act 1946, notification that the following instrument had come into operation before being laid before Parliament, with an explanation thereof; the notification and explanation were ordered to lie on the Table:

    Education (School Teachers’ Pay and Conditions) (No. 4) Order 2005.  (3479)

Public Business

9.  Identity Cards Bill—It was moved by the Baroness Scotland of Asthal that the amendments for the Report stage be marshalled and considered in the following order:

Clauses 1 to 3
Schedule 1
Clauses 4 to 45
Schedule 2;
the motion was agreed to.

10.  Company Law Reform Bill [HL]—It was moved by the Lord Sainsbury of Turville that the bill be now read a second time; after debate, the motion was agreed to and the bill was committed to a Grand Committee.

11.  London Olympic Games and Paralympic Games Bill—It was moved by the Lord Davies of Oldham that the bill be now read a second time; after debate, the motion was agreed to and the bill was committed to a Grand Committee.

The House was adjourned at one minute past eleven o’clock

till tomorrow, eleven o’clock.

APPENDIX

PROCEEDINGS OF THE GRAND COMMITTEE (IN THE MOSES ROOM)

The Committee met at half-past three o’clock.

    Immigration, Asylum and Nationality Bill—The bill was further considered in the Grand Committee; amendments were moved and (by leave of the Committee) withdrawn; the Committee was adjourned after clause 19 stood part.

The Committee was adjourned at twenty-three minutes before eight o’clock.
