The House met at a quarter before ten o’clock.

PRAYERS were read by the Lord Bishop of Chelmsford.

Judicial Business

1.  A (FC) and others (FC) (Appellants) v. Secretary of State for the Home Department (Respondent) (2004)—

2.  A and others (Appellants) (FC) and others v. Secretary of State for the Home Department (Respondent)

    (Conjoined Appeals)—

    It was moved by the Lord Bingham of Cornhill, That the 28th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeals be allowed; that paragraphs 2 and 3 of the Order of the Court of Appeal of 11th August 2004 be set aside; that the determinations of the Special Immigration Appeals Commission of 29th October 2003 in respect of each appellant also be set aside; that the case of each appellant be remitted back to the Special Immigration Appeals Commission; that the question of the evidential basis on which the Special Immigration Appeals Commission should then reconsider the case of each appellant be adjourned in order that the parties may make written submissions to this House within 14 days; and that the question of costs also be adjourned in order that the parties may make written submissions within 14 days. 3.  Deep Vein Thrombosis and Air Travel Group Litigation (8 actions) (formerly 24 actions)—It was moved by the Lord Walker of Gestingthorpe on behalf of the Lord Scott of Foscote, That the 29th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeal be dismissed; that the Order of the Court of Appeal of 3rd July 2003 and also the Order of Mr Justice Nelson in the Queen’s Bench Division of the High Court of Justice of 20th December 2002 be affirmed; and that the question of costs be adjourned in order that the parties may make written submissions within 14 days. 4.  Kola (FC) and another (FC) (Petitioners) v. Secretary of State for Work and Pensions (Respondent) (England)—The appeal of Davida Kola and Ibrahim Mirzajani was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 19th January.

5.  Harb (Petitioner) v. Aziz (deceased) (Respondent)—The petition of Janan George Harb praying for leave to appeal was presented and referred to an Appeal Committee.

6.  Moncrieff (AP) and another (AP) (Respondents) v. Jamieson and others (Appellants) (Scotland)—The respondents’ legal aid certificates were lodged and it was ordered that the time for lodging the statement and appendix and setting down the cause for hearing be extended to 9th January.

The House was adjourned during pleasure.The House was resumed.

9.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.  Reserve Forces (Attributable Benefits Etc.) (Amendment) Regulations 2005, laid under the Reserve Forces Act 1996;

    2.  Amendments to the Fifth Edition of The Queen’s Regulations for the Royal Air Force, laid under the Air Force (Constitution) Act 1917.

Public Business

10.  Business of the House—It was moved by the Lord Grocott, on behalf of the Lord President (Baroness Amos), that the debate on the motion in the name of the Lord Howe of Aberavon set down for today shall be limited to 3 hours and that in the name of the Lord Hurd of Westwell to 2½ hours; the motion was agreed to.

11.  United Kingdom worldwide interests (3-hour debate)—It was moved by the Lord Howe of Aberavon that there be laid before the House papers relating to the resources available for the promotion of the worldwide interests of the United Kingdom; after debate, the motion was (by leave of the House) withdrawn.

12.  Prisons: education and health (2½-hour debate)—It was moved by the Lord Hurd of Westwell that there be laid before the House papers relating to education and health in prisons; after debate, the motion was (by leave of the House) withdrawn.

13.  Civil Aviation Bill—The bill was reported from the Grand Committee with amendments; it was ordered that the bill be printed as amended. (HL Bill 53)

14.  Female genital mutilation—The Baroness Rendell of Babergh asked Her Majesty’s Government what is their attitude to the inclusion of female genital mutilation, carried out under duress, as a ground for asylum application; after debate, the question was answered by the Lord Bassam of Brighton.
