MINUTES OF PROCEEDINGS

The House met at a quarter before ten oclock.
PRAYERS were read by the Lord Bishop of Southwark.
Judicial Business
1. Kent County Council (Appellants) v. G and others (FC) (Respondents)It was moved by the Lord Scott of Foscote, That the 25th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the Order of the Court of Appeal of 27th January 2004 be set aside so far as regards the words complained of and the Order of Mr Justice Johnson in the High Court of Justice, Family Division of 24th October 2003 restored; that there be no Order for the costs of the appeal to this House; and that the costs of the second and third respondents in this House be taxed in accordance with the Access to Justice Act 1999. [2005] UKHL 68
2. Small (Her Majestys Inspector of Taxes) (Respondent) v. Mars UK Limited (Appellants) (England)The appeal of Mars (UK) Limited was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 5th January.
3. Perkin (Petitioner) v. St. Georges Healthcare NHS Trust (Respondents)The petition of Ian Keith Perkin praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.
4. Freakley and others (Appellants) v. Centre Reinsurance International Company and others (Respondents) and one other actionThe appeal was set down for hearing and referred to an Appellate Committee.
5. R (on the application of Laporte) (FC) (Original Appellant and Cross-respondent) v. Chief Constable of Gloucestershire (Original Respondent and Cross-appellant)The petition of the original appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 5th December (the agents for the original respondent consenting thereto) was presented; and it was ordered as prayed.
6. Appeal CommitteeThe following Order was made pursuant to the 29th Report:
- Kola (FC) and another (FC) (Petitioners) v. Secretary of State for Work and Pensions (Respondent)That leave to appeal be given; and that the petition of appeal be lodged by 8th December.
The House was adjourned during pleasure.The House was resumed.

7. Affirmative InstrumentsThe following instruments were laid before the House for approval by resolution and ordered to lie on the Table:
- 1. Draft Producer Responsibility Obligations (Packaging Waste) Regulations 2005, laid under the Environment Act 1995, together with an Explanatory Memorandum;
- 2. Draft Statutory Code of Practice (Scotland): The Duty to Promote Disability Equality, laid under the Disability Discrimination Act 1995, together with an Explanatory Memorandum.
8. Paper not subject to parliamentary proceedingsThe following paper was laid before the House and ordered to lie on the Table:
- Report and Accounts for 2004-05 of the Human Fertilisation and Embryology Authority, laid under the Human Fertilisation and Embryology Act 1990.
Public Business
9. Universities: bureaucracy (Balloted debate)It was moved by the Lord Norton of Louth that there be laid before the House papers relating to the impact of bureaucracy on universities; after debate, the motion was (by leave of the House) withdrawn.
10. Sport in the community (Balloted debate)It was moved by the Lord Pendry that there be laid before the House papers relating to the role of sport in the community; after debate, the motion was (by leave of the House) withdrawn.
11. Transport (Wales) BillThe bill was reported from the Grand Committee without amendment.
12. Asylum (Designated States) (No. 2) Order 2005It was moved by the Lord Bassam of Brighton that the draft Order laid before the House on 24th October be approved; after debate, the motion was agreed to.
13. Retention of Communications Data (Further Extension of Initial Period) Order 2005It was moved by the Lord Bassam of Brighton that the draft Order laid before the House on 3rd November be approved; after debate, the motion was agreed to.
The House was adjourned at four minutes past five oclock
