MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of St Albans.

Judicial Business

1.  Secretary of State for the Home Department (Respondent) v. K (Petitioner)—The petition of K praying for leave to appeal was presented and referred to an Appeal Committee (lodged 6th January).

2.  Bultitude (Petitioner) v. Law Society (Respondents)—The petition of David Bultitude praying for leave to appeal was presented and referred to an Appeal Committee.

3.  R (on the application of X) (FC) (Petitioner) v. Chief Constable of West Midlands Police (Respondent)—The petition of X praying for leave to appeal was presented and referred to an Appeal Committee. The petitioner’s certificate of public funding was lodged.

4.  Barker (Respondent) v. Saint Gobain Pipelines plc (Appellants)—

5.  Patterson (son and executor of the estate of J Patterson (deceased)) (Respondent) v. Smiths Dock Limited (Appellants) and others—

    The appeals were set down for hearing and referred to an Appellate Committee.

7.  Regina v. Secretary of State for Foreign and Commonwealth Affairs (Appellant) ex parte Quark Fishing Limited (Respondents)—

    (Conjoined Appeals)—

    The petition of the appellants praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 7th February (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed.

9.  Appeal Committee—The following Order was made pursuant to the 9th Report:

    Corbett (Petitioner) v. Bond Pearce (a firm) (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

10.  Command Paper—The following paper was presented to the House by command of Her Majesty and ordered to lie on the Table:

    Foreign and Commonwealth Office—Departmental Minute concerning the gifting of body armour to Indonesia.    (—)

11.  Affirmative Instrument—The following instrument was laid before the House for approval by resolution and ordered to lie on the Table:

    Draft Private Security Industry Act 2001 (Amendments to Schedule 2) Order 2005, laid under the Private Security Industry Act 2001, together with an Explanatory Memorandum.

12.  Regulatory Reform—The following orders were laid before the House under section 4(2) of the Regulatory Reform Act 2001 and referred to the Delegated Powers and Regulatory Reform Committee:

    1.  Draft Regulatory Reform (Joint Nature Conservation Committee) Order 2005, together with a Statement by the Department for Environment, Food and Rural Affairs;

    2.  Draft Regulatory Reform (Trading Stamps) Order 2005, together with a Statement by the Department for Trade and Industry.

13.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.  Education (Student Support) (No. 2) Regulations 2002 (Amendment) Regulations 2005, laid under the Teaching and Higher Education Act 1998;    (5)

    2.  Social Security (Claims and Payments and Payments on account, Overpayments and Recovery) Amendment Regulations 2005, laid under the Social Security Administration Act 1992;    (34)

    3.  Immigration (European Economic Area) (Amendment) Regulations 2005, laid under the European Communities Act 1972;    (47)

    4.  Employment (Northern Ireland) Order 2003 (Dispute Resolution) Regulations (Northern Ireland) 2004, laid under the Employment (Northern Ireland) Order 2003.    (—)

14.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Report and Accounts for 2003-04 of the Arts Council of Wales, laid under the National Lottery etc. Act 1993, together with the Report of the Comptroller and Auditor General.

Public Business

15.  Defence—It was moved by the Lord Bach that this House takes note of developments in defence; after debate, the motion was agreed to.

16.  Criminal trials—The Lord Thomas of Gresford asked Her Majesty’s Government, further to the Written Statement by the Attorney General on 20th December 2004 (WS 104-105), whether they propose to change the impartial role of prosecuting counsel, in respect of both the introduction of the previous convictions of a defendant in a criminal trial and the interviewing of prosecution witnesses; after debate, the question was answered by the Lord Goldsmith.

The House was adjourned at twenty-five minutes past nine o’clock

till tomorrow, half-past two o’clock.

APPENDIX

PROCEEDINGS OF THE GRAND COMMITTEE (IN THE MOSES ROOM)

The Committee met at half-past three o’clock.

    Disability Discrimination Bill [HL]—The bill was further considered in the Grand Committee; amendments were moved and (by leave of the Committee) withdrawn; the Committee was adjourned after amendment 61.
