MINUTES OF PROCEEDINGS

Thursday 4th November 2004

The House met at eleven o’clock.

PRAYERS were read by the Lord Bishop of Edmundsbury and Ipswich.

1.  Viscountcy of Oxfuird in the Peerage of Scotland—The Petition of Ian Alexander Arthur Makgill claiming to have succeeded to the Viscountcy of Oxfuird in the Peerage of Scotland and praying that the Clerk of the Parliaments might be directed to enter the petitioner as the 14th Viscount of Oxfuird on his register of hereditary peers maintained under Standing Order 10(5) was presented and was referred to the Lord Chancellor to consider and report upon to the House pursuant to Standing Order 11.

Judicial Business

2.  University of Southampton and another (Respondents) v. Mohtasham (Applicant)—The application of Elahe Mohtasham for permission to appeal was referred to an Appeal Committee.

3.  R (on the application of Dunne) (Applicant) v. Warwickshire Magistrates’ Court (Respondents)—The application of Peter Ivan Dunne for permission to appeal was referred to an Appeal Committee.

4.  R (on the application of Michael) (Applicant) v. Bromley Magistrates’ Court and others (Respondents)—The application of Felicia Michael for permission to appeal was referred to an Appeal Committee.

5.  Appeal Committee—The 116th Report from the Appeal Committee was agreed to and the following Orders were made—

    R (on the application of Markos (Applicant)) v. Southend County Court (Respondents)—That permission to appeal be refused because the application is inadmissible.

    Kaston (Applicant) v. Department for Constitutional Affairs (Respondents)—That permission to appeal be refused because the application is inadmissible.

    Kapadia and others (Respondents) v. Hermmain Properties and others and another (Applicant)—That permission to appeal be refused because the application is inadmissible.

Papers

6.  House of Lords Resource Accounts 2003-04—The Resource Accounts for the year 2003-04 were laid before the House and ordered to be printed. (HL Paper 197)

7.  Command Papers—The following papers were presented to the House by command of Her Majesty and ordered to lie on the Table:

    1.  Regulatory Impact—Regulatory Impact Assessments: 1st January to 30th June 2004;     (6329)

    2.  Education—Government Response to the Report of the House of Commons Education and Skills Committee on Secondary Education: School Admissions.    (6349)

8.  Affirmative Instruments—The following instruments were laid before the House for approval by resolution and ordered to lie on the Table:

    1.  (i)  Draft Freedom of Information (Time for Compliance with Request) Regulations 2004, together with an Explanatory Memorandum—

      (ii)  Draft Freedom of Information (Removal and Relaxation of Statutory Prohibitions on Disclosure of Information) Order 2004, together with an Explanatory Memorandum—

      laid under the Freedom of Information Act 2000.

9.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.  Social Security (Housing Costs Amendments) Regulations 2004, laid under the Social Security Contributions and Benefits Act 1992;  (2825)

    2.  Salmonella in Laying Flocks (Survey Powers) (England) Regulations 2004, laid under the European Communities Act 1972.  (2885)

10.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.  Naval and Marine Pay and Pensions (Pay and Allowances) Order 2004, laid under the Naval and Marine Pay and Pensions Act 1865;

    2.  Accounts for 2003-04 of the Scottish Arts Council National Lottery Distribution Fund, laid under the National Lottery etc Act 1993;

    3.  Third Report of the Independent Monitoring Commission, laid under the International Agreement establishing the Independent Monitoring Commission.

Public Business

11.  Pensions Bill—The bill was further considered on report; amendments were agreed to; amendments were moved (and by leave of the House) withdrawn; an amendment was disagreed to (see division list 1); further consideration on report was adjourned.

12.  National Assembly for Wales (Transfer of Functions) Order 2004—It was moved by the Lord Evans of Temple Guiting that the draft Order laid before the House on 11th October be approved; after debate, the motion was agreed to.

13.  Fishing Boats (Satellite-Tracking Devices) (England) Scheme 2004—It was moved by the Baroness Farrington of Ribbleton that the Scheme laid before the House on 21st September be approved; after debate, the motion was agreed to.

The House was adjourned during pleasure.

The House was resumed.

14.  Pensions Bill—The bill was further considered on report; amendments were agreed to; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to (see division lists 2 to 5); further consideration on report was adjourned after amendment 259.

The House was adjourned at twelve minutes past six o’clock

till tomorrow, eleven o’clock.
