MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Rochester.

Judicial Business

1.  Burton (Her Majesty’s Collector of Taxes) (Respondent) v. Mellham Limited (Appellants) (England)—The appeal of Mellham Limited was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 13th December next.

2.  R (on the application of Bushell and others) (Respondents) v. Newcastle upon Tyne Licensing Justices and others (Appellants) (England)—The appeal of Ultimate Leisure Group plc was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 13th December next.

3.  N (FC) (Appellant) v. Secretary of State for the Home Department (Respondent)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 13th December next (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed.

4.  Glasgow City Council (Respondents) v. Caststop Limited (Appellants) (Scotland)—The petition of the appellants was presented praying that the appeal be withdrawn on the terms agreed between the parties (the agents for the respondents consenting thereto); and it was ordered as prayed.

5.  Appeal Committee—The 111th Report from the Appeal Committee was agreed to and the following Orders were made—

    R (on the application of Jones and others) (Respondents) v. Ceredigion County Council (Petitioners)—That the respondents be invited to lodge objections by 15th November.

    R v. J (Petitioner)—That leave to appeal be given; and that the petition of appeal be lodged by 15th November.

    R v. M (Petitioner)—That leave to appeal be given; and that the petition of appeal be lodged by 15th November.

    R v. P (Petitioner)—That leave to appeal be given; and that the petition of appeal be lodged by 15th November.

    R v. P (Respondent)—That leave to appeal be given; and that the petition of appeal be lodged by 15th November.

    R v. R (Petitioner)—That leave to appeal be given; and that the petition of appeal be lodged by 15th November.

    R v. R (Respondent)—That leave to appeal be given; and that the petition of appeal be lodged by 15th November.

    In re Wellington (Petitioner) (application for a writ of Habeas Corpus)—That the respondents be invited to lodge objections by 15th November.

7.  Statutory Instruments (Standing Order 71)—The following negative instruments, having been laid before the House on 29th October, were ordered to lie on the Table:

      (ii)  Medicines (Vaccination Against Foot-and-Mouth Disease) Order 2004—  (2779)

      laid under the Medicines Act 1968;

    2.  Veterinary Surgery (Vaccination Against Foot-and-Mouth Disease) Order 2004, laid under the Veterinary Surgeons Act 1966;    (2780)

8.  Negative Instrument—The following instrument was laid before the House and ordered to lie on the Table:

    Education (Student Loans) (Repayment) (Amendment) (No. 2) Regulations 2004, laid under the Teaching and Higher Education Act 1998.    (2752)

9.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.  Accounts for 2003-04 of the Arts Council England Lottery Distribution, together with the Report of the Comptroller and Auditor General, laid under the National Lottery etc. Act 1993;

    2.  Accounts for 2003-04 of the National Museum of Science and Industry, together with the Report of the Comptroller and Auditor General, laid under the Museums and Galleries Act 1992;

    3.  Accounts for 2003-04 of the National Criminal Intelligence Service, together with the Report of the Comptroller and Auditor General, laid under the Police Act 1997;

10.  Instrument coming into operation before being laid—The Lord Chancellor acquainted the House that he had received, under the proviso to section 4(1) of the Statutory Instruments Act 1946, notification that the following instrument had come into operation before being laid before Parliament, with an explanation thereof; the notification and explanation were ordered to lie on the Table:

    Medical Act 1983 (Amendment) Order 2002 (Saving Provision) Order of Council 2004.

Public Business

11.  Pensions Bill—The report was received; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; further consideration on report was adjourned.

12.  Sudan: Darfur—The Baroness Cox asked Her Majesty’s Government what is their response to recent developments in Sudan, with particular reference to the crisis in Darfur; after debate, the question was answered by the Baroness Symons of Vernham Dean.

The House was adjourned during pleasure.The House was resumed.

1.  13.  Pensions Bill—The bill was further considered on report; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; further consideration on report was adjourned after amendment 133.
