MINUTES OF PROCEEDINGS

Thursday 18th March 2004

The House met at eleven o’clock.

PRAYERS were read by the Lord Bishop of Oxford.

Judicial Business

1.  Lesotho Highlands Development Authority (Respondents) v. Impregilo SpA and others (Appellants) (England)—The appeal of Impregilo SpA, Hochtief AG, Bouygues SA, Kier International Limited, Stirling International Civil Engineering Limited, Concor Holdings (Pty) Limited and Group Five Construction (Pty) Limited was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 29th April next.

2.  Mark (Respondent) v. Mark (Petitioner)—The petition of David Alechenu Bonaventure Mark praying for leave to appeal was presented and referred to an Appeal Committee.

3.  O’Brien (Respondent) v. Chief Constable of South Wales Police (Appellant)—It was ordered that the appeal of the Chief Constable of South Wales Police be dismissed in accordance with Standing Order V, the appellants having failed to give security for costs by 4th March.

4.  Instrument withdrawn—The following instrument, laid before the House on 23rd February was withdrawn:

    Draft National Minimum Wage Regulations 1999 (Amendment) Regulations 2004.

5.  Affirmative Instruments—The following instruments were laid before the House for approval by resolution and ordered to lie on the Table:

    1.  Draft National Minimum Wage Regulations 1999 (Amendment) Regulations 2004, laid under the National Minimum Wage Act 1998, together with an Explanatory Memorandum;

    2.  Draft Parliamentary Elections (Northern Ireland) Regulations 2004, laid under the European Parliamentary Elections Act 2002, together with an Explanatory Memorandum.

6.  Regulatory Reform—The following order was laid before the House under section 6(1) of the Regulatory Reform Act 2001 and referred to the Delegated Powers and Regulatory Reform Committee:

    Draft Regulatory Reform (Local Commissioner for Wales) Order 2004, together with a statement by the Wales Office.

7.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.  National Assistance (Sums for Personal Requirements and Assessment of Resources) (Amendment) (England) Regulations 2004, laid under the National Assistance Act 1948;    (760)

    2.    (i)  Asylum Support (Amendment) Regulations 2004—    (763)

      (ii)  Immigration Services Commissioner (Designated Professional Body) (Fees) Order 2004—  (801)

      (iii)  Immigration Services Commissioner (Registration Fee) Order 2004—  (802)

      laid under the Immigration and Asylum Act 1999;

    3.  Tobacco Advertising and Promotion (Point of Sale) Regulations 2004, laid under the Tobacco Advertising and Promotion Act 2002;    (765)

    4.    (i)  Recovery of Agricultural Levies Due in Other Member States Regulations 2004—    (800)

      (ii)     Zimbabwe (Freezing of Funds and Economic Resources) Regulations 2004—  (816)

      laid under the European Communities Act 1972;

    5.  LEA Budget, Schools Budget and Individual Schools Budget (Wandsworth) (Amendment) Regulations 2004, laid under School Standards and Framework Act 1998.    (804)

Public Business

8.  Patents Bill [HL]—It was moved by the Lord Triesman, on behalf of the Lord Sainsbury of Turville, that the amendments for the Report stage be marshalled and considered in the following order:

Clauses 1 to 5
Schedule 1
Clauses 6 to 15

Schedules 2 and 3
Clauses 16 and 17;

    the motion was agreed to.

9.  European Parliamentary and Local Elections (Pilots) Bill—The Commons amendments were considered; an amendment to the motion that the House do agree with a Commons amendment in lieu of a Commons amendment to which the Lords had disagreed was agreed to (see division list 1); then the motion (as amended) was agreed to; a Lords amendment was not insisted on and a Commons amendment in lieu thereof was agreed to; then the bill was returned to the Commons with an amendment.

The House was adjourned during pleasure.

10.  Energy Bill [HL]—After debate, the report was received; consideration on report was adjourned.

11.  Social Security (Basic Skills Training Pilot) Regulations 2004—It was moved by the Baroness Hollis of Heigham that the draft Regulations laid before the House on 12th February be approved; after debate, the motion was agreed to.

12.  Social Security (Intensive Activity Period 50 to 59 Pilot) Regulations 2004—It was moved by the Baroness Hollis of Heigham that the draft Regulations laid before the House on 12th February be approved; after debate, the motion was agreed to.

13.  Social Security (Intensive Activity Period 50 to 59 Pilot) (No. 2) Regulations 2004—It was moved by the Baroness Hollis of Heigham that the draft Regulations laid before the House on 12th February be approved; the motion was agreed to.

14.  Jobseeker’s Allowance (Amendment) Regulations 2004—It was moved by the Baroness Hollis of Heigham that the draft Regulations laid before the House on 2nd March be approved; after debate, the motion was agreed to.

15.  Employment Zones (Allocation to Contractors) Pilot Regulations 2004—It was moved by the Baroness Hollis of Heigham that the draft Regulations laid before the House on 16th March be approved; the motion was agreed to.

16.  Energy Bill [HL]—The bill was further considered on report; amendments were agreed to (see division lists 2 and 3); amendments were moved and (by leave of the House) withdrawn; an amendment was disagreed to (see division list 4); further consideration on report was adjourned after amendment 35.

The House was adjourned at twenty-three minutes past seven o’clock

to Monday next, half-past two o’clock.

APPENDIX

PROCEEDINGS OF THE GRAND COMMITTEE (IN THE MOSES ROOM)

The Committee met at a quarter past three o’clock.

    Child Trust Funds Bill—The bill was considered in the Grand Committee; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the Committee was adjourned after amendment 30.
