MINUTES OF PROCEEDINGS

Monday 8th March 2004

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Chelmsford.

Judicial Business

1.  Polanski (Appellant) v. Conde Nast Publications Limited (Respondents) (England)—The appeal of Roman Polanski was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 19th April next.

2.  Hariri (FC) (Petitioner) v. Secretary of State for the Home Department (Respondent)—The petition of Abdurahman Hariri praying for leave to appeal was presented and referred to an Appeal Committee. The petitioner’s certificate of public funding was lodged.

3.  Oxfordshire County Council (Respondents) v. Oxford City Council (Petitioners) and another (Respondent)—The petition of Oxford City Council praying for leave for an appeal to be brought direct from the High Court of Justice in accordance with Part II of the Administration of Justice Act 1969 was presented and referred to an Appeal Committee.

4.  In re Sinn Fein (Petitioners) (Northern Ireland)—The petition of Sinn Fein praying for leave to appeal was presented and referred to an Appeal Committee (lodged 4th March).

5.  Steamship Mutual Underwriting Association (Bermuda) Limited (Respondents) v. Feasey (a representative Lloyd’s underwriter suing on his own behalf and on behalf of all the members of Syndicate 957) (Petitioner) and one other action—The petition of Anthony Feasey praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.

6.  X (FC) and another (FC) (Appellants) v. Secretary of State for the Home Department (Respondent)—The appeal was set down for hearing and referred to an Appellate Committee.

7.  Regina v. Secretary of State for the Home Department (Respondent) ex parte Al-Hasan (FC) (Appellant)—

8.  Regina v. Secretary of State for the Home Department (Respondent) ex parte Carroll (FC) (Appellant)—

    (Conjoined Appeals)—

    The petition of the appellants praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 15th April next (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed (lodged 4th March).

9.  Archibald (Appellant) v. Fife Council (Respondents) (Scotland)—It was ordered that the appellant be allowed to prosecute the appeal without giving the usual security for costs as required by Standing Order.

10.  In re McKerr (AP) (Respondent) (Northern Ireland)—The respondent’s legal aid certificate was lodged.

Select Committee Report

13.  Human Rights—The 8th Report from the Joint Committee, Scrutiny of Bills: Progress Report, together with Appendices, was made and ordered to be printed. (HL Paper 49)

Public Business

14.  Business of the House—It was moved by the Lord President (Baroness Amos) that Standing Order 41 (Arrangement of the Order Paper) be dispensed with on Friday 26th March to allow the motion standing in the name of the Lord Archbishop of Canterbury to be taken first; the motion was agreed to.

15.  Constitutional Reform Bill [HL]—The Queen’s consent was signified; then it was moved by the Lord Falconer of Thoroton that the bill be now read a second time; after debate, the motion was agreed to; then it was moved by the Lord Falconer of Thoroton that the bill be committed to a Committee of the Whole House; then it was moved by the Lord Lloyd of Berwick, as an amendment thereto, to leave out “Committee of the Whole House” and insert “Select Committee”; the amendment was agreed to (see division list); then the original motion, as amended, was agreed to.

16.  Patents Bill [HL]—The bill was reported from the Grand Committee with amendments; it was ordered that the bill be printed as amended. (HL Bill 40)

    Patents Bill [HL]—The bill was considered in the Grand Committee; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; it was ordered that the bill be reported with amendments.
