MINUTES OF PROCEEDINGS

Monday 1st March 2004

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Rochester.

1.  Lord Vivian—The Lord Chancellor acquainted the House that Lord Vivian, a member of the House, had died on 28th February 2004.

2.  Barony of Grimthorpe in the Peerage of England—The Petition of Edward John Beckett claiming to have succeeded to the Barony of Grimthorpe in the Peerage of England and praying that the Clerk of the Parliaments might be directed to enter the petitioner as the Lord Grimthorpe on his register of hereditary peers maintained under Standing Order 10(5) was presented and was referred to the Lord Chancellor to consider and report upon to the House pursuant to Standing Order 11.

Judicial Business

3.  Kent County Council (Petitioners) v. G and others (Respondents)—The petition of Kent County Council praying for leave to appeal was presented and referred to an Appeal Committee (lodged 26th February).

4.  MacDonald (Her Majesty’s Inspector of Taxes) (Respondent) v. Dextra Accessories Limited and others (Petitioners)—The petition of Dextra Accessories Limited, Phones 4U Limited, The Mobile Phone Repair Company Limited, 4U Limited, 20:20 Logistics Limited and Singlepoint (4U) Limited praying for leave to appeal was presented and referred to an Appeal Committee.

5.  Fraser and another (Petitioners) v. Canterbury Diocesan Board of Finance and others (Respondents)—The petition of Simon Richard Fraser and Nathan George Fraser praying for leave to appeal was presented and referred to an Appeal Committee.

6.  Brooks (FC) (Respondent) v. Commissioner of Police for the Metropolis (Appellant) and others—The appeal was set down for hearing and referred to an Appellate Committee.

7.  Attorney General’s Reference No. 5 of 2002 (On Appeal from the Court of Appeal (Criminal Division))—The reference was set down for hearing and referred to an Appellate Committee.

8.  Command Papers—The following papers, having been presented to the House by command of Her Majesty on the 27th February, were ordered to lie on the Table:

9.  Statutory Instruments (Standing Order 71)—The following negative instruments, having been laid before the House on 27th February, were ordered to lie on the Table:

    1.  Income Support (General) (Standard Interest Rate Amendment) Regulations 2004, laid under the Social Security Contributions and Benefits Act 1992;    (440)

    2.    (i)  School Budget Shares (Prescribed Purposes) (England) (Amendment) Regulations 2004—    (444)

      laid under the Schools Standards and Framework Act 1998;

    4.  Goods Vehicles (Licensing of Operators) (Temporary Use in Great Britain) (Amendment) Regulations 2004, laid under the Goods Vehicle (Licensing of Operators) Act 1995.    (462)

10.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.  Statutory Paternity Pay and Statutory Adoption Pay (Amendment) Regulations 2004, laid under the Social Security Contributions and Benefits Act 1992;  (488)

    2.  Draft Royal Parks and Other Open Spaces (Amendment) Regulations 2004, laid under the Parks Regulation (Amendment) Act 1926.  (—)

11.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.  Accounts for 2002-03 of the Greenwich Hospital and Travers Foundation, laid under the Armed Forces Act 1976;

    2.  Call-Out Order, laid under the Reserve Forces Act 1996;

    3.  Amendment List 8 to Air Publication 3394: The Royal Airforce Aeromedical Evacuation Service (Third Edition), laid under the Air Force (Constitution) Act 1917;

    4.  Accounts for 2000-02 of Funds in Court in respect of the Supreme Court and the County Courts in Northern Ireland, laid under the Judicature (Northern Ireland) Act 1978, together with the Report of the Comptroller and Auditor General;

    5.  Summary Accounts for 2001-02 of Health and Personal Social Services and Special Agencies of Northern Ireland, laid under the Health and Personal Social Services (Northern Ireland) Order 1972.

Public Business

12.  Human Rights Act 1998 (Making of Remedial Orders) Amendment Bill [HL]—A bill to amend Schedule 2 to the Human Rights Act 1998 in respect of the periods of time applying to the stages in making a remedial order under section 10 of that Act was presented by the Lord Lester of Herne Hill, read a first time and ordered to be printed. (HL Bill 32)

13.  European Parliamentary and Local Elections (Pilots) Bill—The bill was read a third time; an amendment was moved and (by leave of the House) withdrawn; then the bill was passed and returned to the Commons with amendments.

14.  Social Security (Contributions) (Re-rating and National Insurance Funds Payments) Order 2004—It was moved by the Lord Davies of Oldham that the draft Order laid before the House on 4th February be approved; after debate, the motion was agreed to.

15.  Planning and Compulsory Purchase Bill—The bill was further considered on report; amendments were agreed to (see division lists 1 and 2); further amendments were agreed to; amendments were moved and (by leave of the House) withdrawn; an amendment was disagreed to (see division list 3); further consideration on report was adjourned.

The House was adjourned during pleasure.

The House was resumed.

16.  Consolidation Bills—The first report from the Joint Committee, being a report on the Statute Law (Repeals) Bill [HL], was made and ordered to be printed (together with the minutes of proceedings and the minutes of evidence). (HL Paper 46-I and II)

17.  Statute Law (Repeals) Bill [HL]—The bill was reported from the Joint Committee with amendments and re-committed to a Committee of the Whole House; it was ordered that the bill be printed as amended. (HL Bill 33)

18.  Planning and Compulsory Purchase Bill—The bill was further considered on report; amendments were moved and (by leave of the House) withdrawn; an amendment was agreed to; further consideration on report was adjourned after amendment 138.

The House was adjourned at thirteen minutes past ten o’clock

APPENDIX

The Committee met at half-past three o’clock.

    Energy Bill [HL]—The bill was further considered in the Grand Committee; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the Committee was adjourned after clause 151 stood part.
