The House met at half-past two o’clock.
PRAYERS were read by the Lord Bishop of St Albans.
1. Lord Carswell—The Right Honourable Sir Robert Douglas Carswell, Knight, Lord Chief Justice of Northern Ireland, having been appointed a Lord of Appeal in Ordinary and created Baron Carswell, of Killeen in the County of Down, for life by Letters Patent dated in the afternoon of 12th January 2004, was introduced between the Lord Rodger of Earlsferry and the Lord Hutton, the Gentleman Usher of the Black Rod and Garter King of Arms preceding; and took and subscribed the oath pursuant to statute.
2. Lord Brown of Eaton-under-Heywood—The Right Honourable Sir Simon Denis Brown, Knight, a Lord Justice of Appeal, having been appointed a Lord of Appeal in Ordinary and created Baron Brown of Eaton-under-Heywood, of Eaton-under-Heywood in the County of Shropshire, for life by Letters Patent dated 13th January 2004, was introduced between the Lord Woolf and the Lord Phillips of Worth Matravers, the Gentleman Usher of the Black Rod and Garter King of Arms preceding; and took and subscribed the oath pursuant to statute.
3. Baroness Pike—The Lord Chancellor acquainted the House that Baroness Pike, a member of the House, had died on 11th January 2004.
Judicial Business
4. Regina v. Secretary of State for the Home Department (Respondent) ex parte Ekinci (FC) (Petitioner)—The petition of Hasan Ekinci praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee. The petitioner’s certificate of public funding was lodged.

5. Negative Instrument—The following instrument was laid before the House and ordered to lie on the Table:

6. Statutory Instruments—The 4th Report from the Joint Committee was made on certain statutory instruments, including the following affirmative instruments:
Draft Industrial Training Levy (Construction Board) Order 2004;
Draft Industrial Training Levy (Engineering Construction Board) Order 2004;
it was ordered that the Report be printed. (HL Paper 20)

7. Domestic Violence, Crime and Victims Bill [HL]—It was moved by the Lord Bassam of Brighton, on behalf of the Baroness Scotland of Asthal, that it be an instruction to the Grand Committee to which the Domestic Violence, Crime and Victims Bill has been committed that they consider the bill in the following order:

8. Justice (Northern Ireland) Bill [HL]—It was moved by the Lord Davies of Oldham, on behalf of the Lord President (Baroness Amos), that it be an instruction to the Committee of the Whole House to which the Justice (Northern Ireland) Bill has been committed that they consider the bill in the following order:

9. Defence—It was moved by the Lord Bach that this House takes note of the Defence White Paper: Delivering Security in a Changing World (Cm 6041); after debate, the motion was agreed to.
10. Tidal power—The Lord Hooson asked Her Majesty’s Government whether they will explore the potential of harnessing tidal power to produce electricity; and in particular whether they will set up a full study of the feasibility and cost of harnessing the tides in the Severn estuary; after debate, the question was answered by the Lord Sainsbury of Turville.
