My Lords,

     55. I have had the advantage of reading in draft the speeches of my noble and learned friends, Lord Hoffmann and Lord Hobhouse of Woodborough. For the reasons which they give I would allow the appeal, dismiss the cross-appeal and answer the preliminary issues in the way they propose.
