MINUTES OF PROCEEDINGS

Die Martis 30° Aprilis 2002

The House met at ten o’clock.

PRAYERS were read by the Lord Bishop of Southwark.

1.  The Queen’s Golden Jubilee—It was moved by the Lord Privy Seal (Lord Williams of Mostyn) that the House do now proceed to Westminster Hall for the purpose of presenting the Humble Address ordered yesterday to be presented to Her Majesty; and that thereafter the House do adjourn during pleasure and do meet again in this Chamber at half-past two o’clock; the motion was agreed to.

    Then the House proceeded to Westminster Hall, where the Lord Chancellor presented to Her Majesty the Humble Address ordered yesterday, and Her Majesty was graciously pleased to make Reply.

The House was adjourned during pleasure.

The House was resumed.

Judicial Business

2.  Wainwright and another (Appellants) v. Home Office (Respondents) (England)—The appeal of Mary Jane Wainwright and Alan Joseph Wainwright was presented without payment of the fee, such fee having been waived by the Appeal Committee pursuant to Standing Order XIII and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 11th June next (lodged 11th April).

3.  Wainwright and another (Appellants) v. Home Office (Respondents)—It was ordered that the appellants be allowed to prosecute the appeal without giving the usual security for costs as required by Standing Order.

4.  Bellinger (FC) (Appellant) v. Bellinger (Respondent)—The Lord Chancellor’s Department was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

5.  Appeal Committee—The following Order was made pursuant to the 71st Report:

    Lloyds TSB General Insurance Holdings Limited and others (Respondents) v. Lloyds Bank Group Insurance Company Limited (Petitioners) and one other action—That the petition be referred for hearing.

6.  Appeal Committee—The 82nd Report from the Appeal Committee was agreed to and the following Orders were made—

    Loutchansky (Respondent) v. Times Newspapers Limited and others (Petitioners) and one other action—That leave to appeal be refused.

    Al-Fagih (Petitioner) v. HH Saudi Research & Marketing (UK) Limited (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Gingi (FC) (Petitioner) v. Secretary of State for Work and Pensions (Respondent)—That leave to appeal be refused; that the costs of the petitioner be taxed in accordance with the Access to Justice Act 1999; and that the respondent be at liberty to apply for his costs in accordance with direction 5.1(c); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Regina v. Secretary of State for Transport (now Secretary of State for the Environment, Transport and the Regions) (Respondent) ex parte Factortame Limited and others (Petitioners)—That leave to appeal be refused; that the respondent be at liberty to apply for his costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Vellino (FC) (by his mother and next friend) (Petitioner) v. Chief Constable of the Greater Manchester Police (Respondent)—That leave to appeal be refused; that the costs of the petitioner be taxed in accordance with the Access to Justice Act 1999; and that the respondent be at liberty to apply for his costs in accordance with direction 5.1(c); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

7.  Command Paper—The following paper was presented to the House by command of Her Majesty and ordered to lie on the Table:

    Cultural Property—Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, together with an Explanatory Memorandum.      (5500)

8.  Affirmative Instrument—The following instrument was laid before the House for approval by resolution and ordered to lie on the Table:

    Draft Dentists Act 1984 (Dental Auxiliaries) Order 2002, together with an Explanatory Memorandum.

9.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    (i) Draft Code of Practice for Schools—      (—)

    (ii) Draft Code of Practice for Providers of Post 16 Education and Related Services—      (—)

    (iii) Rail Vehicle Accessibility (Middleton Railway Drewry Car) Exemption Order 2002—      (1188)

laid under the Disability Discrimination Act 1995.

10.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.      Revised Code of Practice by the Department for Work and Pensions on Obtaining Information, laid under the Social Security Fraud Act 2001;

    2.      Accounts for 2000-01 for the United Kingdom Central Council for Nursing, Midwifery and Health Visiting, laid under the Nurses, Midwives and Health Visitors Act 1997.

11.  Instrument coming into operation before being laid—The Lord Chancellor acquainted the House that he had received, under the proviso to section 4(1) of the Statutory Instruments Act 1946, notification that the following instrument had come into operation before being laid before Parliament, with an explanation thereof; the notification and explanation were ordered to lie on the Table:

    National Health Service Pension Scheme (Amendment) Regulations 2002.

Select Committee Reports

12.  Consolidation Bills—The First Report from the Joint Committee, being a report on the European Parliamentary Elections Bill [HL], was made and ordered to be printed (together with the minutes of proceedings and the minutes of evidence). (HL Paper 114-I and II)

13.  Statutory Instruments—The 27th Report from the Joint Committee was made on certain statutory instruments; it was ordered that the Report be printed. (HL Paper 115)

14.  European Union—The following Reports from the Select Committee were made and ordered to be printed, together with the Minutes of Evidence:

    Evidence by the Minister of State, Foreign and Commonwealth Office, on the Barcelona European Council; (21st Report-HL Paper 116)

    Labelling and Tracing of GM Food and Animal Feed: Informing the Consumer. (22nd Report-HL Paper 117)

Public Business

15.  National Health Service Reform and Health Care Professions Bill—The bill was further considered on report; amendments were moved and (by leave of the House) withdrawn; an amendment was agreed to (see division list 1); amendments were agreed to; an amendment was disagreed to (see division list 2); it was ordered that the bill be printed as amended. (HL Bill 78)

16.  European Parliamentary Elections Bill [HL]—The bill was reported from the Joint Committee without amendment and re-committed to a Committee of the Whole House.

17.  Rural policy—The Lord Patten asked Her Majesty’s Government what is their definition of “rural” when used in respect of public policy; after debate, the question was answered by the Lord Whitty.

The House was adjourned at nineteen minutes past nine o’clock

till tomorrow, half-past two o’clock.
