MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Manchester.

1.  Leave of Absence—It was ordered that leave of absence be granted to the Lord Wallace of Coslany for the remainder of this Parliament.

Judicial Business

2.  Guild (Petitioner) v. Eskandar Limited and others (Respondents) and one other action—The petition of Shirin Guild praying for leave to appeal was presented and referred to an Appeal Committee.

3.  Cornhill Insurance plc (Petitioners) v. D E Stamp Felt Roofing Contractors Limited (Respondents)—The petition of Cornhill Insurance plc praying for leave to appeal was presented and referred to an Appeal Committee.

4.  Regina v. Central Valuation Officer and another (Respondent) ex parte Edison First Power Limited (Appellants)—The petition of Powergen (UK) plc praying for leave to intervene in the said appeal was presented and referred to an Appeal Committee.

5.  D’Souza (Appellant) v. London Borough of Lambeth (Respondents)—The appeal was set down for hearing and referred to an Appellate Committee.

6.  Bairstow (Appellant) and others v. Queens Moat Houses plc (Respondents)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 13th May next (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed.

7.  Wrexham County Borough Council (Appellants) v. Berry (Respondent)—It was ordered that the appellants be allowed to prosecute the appeal without giving the usual security for costs as required by Standing Order.

8.  South Bucks District Council (Appellants) v. Porter and another (Respondents)—It was ordered that the appellants be allowed to prosecute the appeal without giving the usual security for costs as required by Standing Order.

9.  Chichester District Council (Appellants) v. Searle and others (Respondents)—It was ordered that the appellants be allowed to prosecute the appeal without giving the usual security for costs as required by Standing Order.

10.  Appeal Committee—The following Order was made pursuant to the 50th Report:

    Royal and Sun Alliance Insurance Group plc (Respondents) v. Her Majesty’s Commissioners of Customs and Excise (Petitioners)—That leave to appeal be given on terms that the order as to costs below should not be disturbed and that the petitioners should bear their costs before this House in any event; and that the petition of appeal be lodged by 29th April.

11.  Appeal Committee—The 75th Report from the Appeal Committee was agreed to and the following Order was made—

    Regina v. Secretary of State for the Home Department ex parte Saadi (FC) and others (FC) (Appellants)—That the petition of the Aire Centre and Liberty that they might be heard or otherwise intervene in the said appeal be allowed to the extent that they may lodge written submissions only.

12.  Affirmative Instrument—The following instrument was laid before the House for approval by resolution and ordered to lie on the Table:

    Police and Criminal Evidence Act 1984 (Codes of Practice) (Visual Recording of Interviews) Order 2002, together with an Explanatory Memorandum.

13.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.      Explosives (Fireworks) Regulations (Northern Ireland) 2002, laid under the Explosives Act (Northern Ireland) 1970;      (—)

    2.      Greater London Authority (Declaration of Acceptance of Office) Order 2002, laid under the Greater London Authority Act 1999;      (1044)

    3.      Local Authorities (Executive Arrangements) (Modification of Enactments) (England) Order 2002, laid under the Local Government Act 2000;      (1057)

    4.      Plant Health (England) (Amendment) Order 2002, laid under the Plant Health Act 1967;      (1067)

    5.      National Health Service (Clinical Negligence Scheme) Amendment Regulations 2002, laid under the National Health Service Act 1977.      (1073)

14.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.      Report of Call-Out of Members of the Reserve Forces, laid under the Reserve Forces Act 1996;

    2.      Report and Accounts for 2001 of the Independent Television Commission, laid under the Broadcasting Act 1990;

    3.      Strategic Plans for 2002-07 of the Community Fund for England, Scotland, Wales and Northern Ireland, laid under the National Lottery Act 1998.

Public Business

15.  Copyright, etc. and Trade Marks (Offences and Enforcement) Bill—A bill to amend the Copyright, Designs and Patents Act 1988 in respect of criminal offences, search warrants, powers of seizure and orders for forfeiture; to amend the Trade Marks Act 1994 in respect of search warrants and powers of seizure; and for connected purposes was brought from the Commons, read a first time and ordered to be printed. (HL Bill 71)

16.  Copyright, etc. and Trade Marks (Offences and Enforcement) Bill—It was ordered that the Explanatory Notes relating to the bill be printed. (HL Bill 71-EN)

17.  Divorce (Religious Marriages) Bill—A bill to make provision enabling a court to require the dissolution of a religious marriage before granting a civil divorce was brought from the Commons, read a first time and ordered to be printed. (HL Bill 72)

18.  Commonhold and Leasehold Reform Bill [HL]—The Commons amendments were considered; a motion that the House do disagree with a Commons amendment was withdrawn; then the amendment was agreed to with a consequential amendment; an amendment to a further Commons amendment was withdrawn and the Commons amendment was agreed to; the remaining Commons amendments were agreed to and the privilege amendment was agreed to; then the bill was returned to the Commons with an amendment.

19.  Police Reform Bill [HL]—The report was received; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; a further amendment was agreed to (see division list); further consideration on report was adjourned.

20.  Financial Services and Markets Act 2000 (Regulated Activities) (Amendment) Order 2002—It was moved by the Lord McIntosh of Haringey that the Order laid before the House on 14th March be approved; then it was moved by the Lord Lipsey, as an amendment thereto, at end to insert “but this House regrets that Her Majesty’s Government have postponed fulfilling their pledge to the House to introduce a similar Order for the regulation of long-term care assurance.”; after debate, the amendment was (by leave of the House) withdrawn; then the original motion was agreed to.

21.  Police Reform Bill [HL]—The bill was further considered on report; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; further consideration on report was adjourned after amendment 131.

The House was adjourned at six minutes past ten o’clock

till tomorrow, half-past two o’clock.
