MINUTES OF PROCEEDINGS

The House met at three o’clock.

PRAYERS were read by the Lord Bishop of Portsmouth.

1.  Affirmation—Robert Lord Gavron made and subscribed the solemn affirmation pursuant to statute.

Judicial Business

2.  Regina v. British Broadcasting Corporation (Petitioners) ex parte Prolife Alliance (Respondents)—The petition of the British Broadcasting Corporation praying for leave to appeal was presented and referred to an Appeal Committee.

3.  Owners of cargo lately laden on board the ship or vessel “Starsin” and others (Original Respondents and Cross-appellants) v. Owners and/or demise charterers of the ship or vessel “Starsin” (Original Appellants and Cross-respondents) and two other actions—The appeal was set down for hearing and referred to an Appellate Committee.

4.  Regina v. Saunby (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

5.  Regina v. Clarkson (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

6.  Regina v. English (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

7.  Regina v. Williams (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

8.  Regina v. Dodds (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

9.  Regina v. Leese (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

10.  Regina v. Marsh (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

11.  Regina v. Webb (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

12.  Regina v. Ashby (Appellant) (On Appeal from Her Majesty’s Courts Martial Appeal Court)—The Secretary of State for Defence was joined to the appeal on behalf of the Crown in accordance with practice direction 31.

13.  BICC plc v. Parkman Consulting Engineers (a firm) (Respondents) and others (Appellants)—Upon application by the appellants, it was ordered that the appeal be withdrawn on the terms agreed between the parties (the agents for the respondents consenting thereto); and it was ordered as prayed.

14.  Appeal Committee—The 74th Report was made; the Appeal Committee reported that they had met and had heard Counsel; the report was agreed to and the following Order was made—

    Grobbelaar (Appellant) v. News Group Newspapers Limited and another (Respondents)—That on the qualified privilege point, leave to cross-appeal was necessary and that such leave should be refused; that on the misdirection point, leave to cross-appeal was not necessary, that the respondents are at liberty to develop their argument on this point in their written case but that they should within 14 days set out in a letter to the Clerk of the Parliaments the points on which they claim that there was a misdirection; and that the costs of the appellant be paid by the respondents, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

15.  Command Papers—The following papers were presented to the House by command of Her Majesty and ordered to lie on the Table:

16.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.      Accounts for 1999-2000 of the Hackney Education Action Zone, together with the Report of the Comptroller and Auditor General, laid under the School Standards and Framework Act 1998;

    2.      Accounts for 2000-01, of the following Education Action Zones, together with the Reports of the Comptroller and Auditor General:

      (i)      Birmingham—

      (iii)      Newcastle—

      (iv)      North West Shropshire—

      (v)      Sheffield—

laid under the School Standards and Framework Act 1998;

    3.      Accounts for 2000-01 of the National Lottery Distribution Fund, together with the Report of the Comptroller and Auditor General, laid under the National Lottery etc. Act 1993;

    4.      Accounts for 2000-01 of the Social Fund, together with the Report of the Comptroller and Auditor General, laid under the Social Security (Administration) Act 1992.

17.  Special Procedure Order—The following special procedure order was laid before the House, together with the certificate of the Secretary of State for Environment, Food and Rural Affairs, and ordered to lie on the Table:

    South West Water Limited, Ilsham Valley Pumping Station, Compulsory Purchase Order 2000.

Public Business

18.  Proceeds of Crime Bill—It was moved by the Lord Bassam of Brighton, on behalf of the Lord Rooker, that it be an instruction to the Committee of the Whole House to whom the Proceeds of Crime Bill has been committed that they consider the bill in the following order:

19.  National Health Service Reform and Health Care Professions Bill—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; an amendment was disagreed to (see division list); the House was resumed.

20.  Child Support (Miscellaneous Amendments) Regulations 2002—It was moved by the Baroness Hollis of Heigham that the draft Regulations laid before the House on 13th March be approved; after debate, the motion was agreed to.

21.  Mental Health Act 1983 (Remedial) Order 2001—It was moved by the Lord Filkin that the Order laid before the House on 19th November 2001 be approved; after debate, the motion was agreed to.

22.  Electricity and Gas (Determination of Turnover for Penalties) Order 2002—It was moved by the Lord McIntosh of Haringey that the draft Order laid before the House on 28th February be approved; after debate, the motion was agreed to.

23.  National Health Service Reform and Health Care Professions Bill—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the House was resumed and the bill was reported with amendments; it was ordered that the bill be printed as amended. (HL Bill 70)

The House was adjourned at twelve minutes past midnight
