MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Bristol.

1.  Leave of Absence—It was ordered that leave of absence be granted to the Lord Rayne for the remainder of this Parliament.

Judicial Business

2.  Trafigura Beheer BV (Respondents) v. BCL Trading GmbH (Petitioners)—The petition of BCL Trading GmbH praying for leave to appeal was presented and referred to an Appeal Committee (lodged 8th March).

3.  Her Majesty’s Attorney General (Appellant) v. Punch Limited and another (Respondents)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 23rd April next (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed.

4.  Appeal Committee—The 67th Report from the Appeal Committee was agreed to and the following Orders were made—

    In re Kaminskas (Respondent) (application for a writ of Habeas Corpus)—That leave to appeal be refused.

    Actionstrength Limited (t/a Vital Resources (formerly t/a Morson Alltrades)) (company number 2761631) (Petitioners) v. International Glass Engineering In.Gl.En. SpA and others (Respondents)—That the respondents be invited to lodge objections by 26th March.

    Commissioners of Customs and Excise (Respondents) v. Barclays Bank plc (Petitioners)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Legal & General Assurance Society Limited (Respondents) v. Kirk (Petitioner)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Mirvahedy (Respondent) v. Henley and another (Petitioners)—That the respondent be invited to lodge objections by 26th March.

    London Borough of Harrow (Petitioners) v. Qazi (Respondent)—That the respondent be invited to lodge objections by 26th March.

    Sinclair (FC) (Petitioner) v. Chief Constable of the West Yorkshire Police and others (Respondents)—That leave to appeal be refused; that the costs of the petitioner be taxed in accordance with the Access to Justice Act 1999; and that the respondents be at liberty to apply for their costs in accordance with direction 5.1(c); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

5.  Appeal Committee—The 68th Report from the Appeal Committee was agreed to and the following Order was made—

    Wilson and others v. Secretary of State for Trade and Industry (Appellant)—That the petition of Her Majesty’s Attorney General on behalf of the Speaker of the House of Commons and the Clerk of the Parliaments that they might be heard or otherwise intervene in the said appeal be allowed.

6.  Appeal Committee—The 69th Report from the Appeal Committee was agreed to and the following Order was made—

    In re Devine (Petitioner) (Northern Ireland)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

7.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.      Social Security (Incapacity) (Miscellaneous Amendments) Regulations 2002, laid under the Social Security Contributions and Benefits Act 1992;      (491)

    2.      Health and Safety (Fees) Regulations 2002, laid under the European Communities Act 1972.      (655)

8.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    List of New and Supplementary Civil List Pensions, laid under the Civil List Act 1972.

9.  Statutory Instruments—The 22nd Report from the Joint Committee was made on certain statutory instruments, including the following affirmative instruments:

      Draft Social Security Administration Act 1992 (Amendment) Order 2002;

      Draft Electricity and Gas (Determination of Turnover for Penalties) Order 2002;

      Draft Limited Liability Partnerships (No. 2) Regulations 2002;

      Draft Companies (Particulars of Usual Residential Address) (Confidentiality Orders) Regulations 2002;

      Draft Limited Liability Partnerships (Particulars of Usual Residential Address) (Confidentiality Orders) Regulations 2002;

      Companies (Competent Authority) (Fees) Regulations 2002;

      Limited Liability Partnerships (Competent Authority) (Fees) Regulations 2002;

    it was ordered that the Report be printed. (HL Paper 96)

Private Business

10.  HSBC Investment Banking Bill [HL]—The bill was reported from the Unopposed Bill Committee with amendments.

Public Business

11.  Consolidated Fund (No. 2) Bill—A bill to authorise the use of resources for the service of the year ending on 31st March 2002 and to apply certain sums out of the Consolidated Fund to the service of the years ending on 31st March 2001 and 2002 was brought from the Commons endorsed with the certificate of the Speaker that the bill is a money bill and read a first time.

12.  Police Reform Bill [HL]—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the House was resumed.

13.  Hepatitis “C”—The Lord Morris of Manchester asked Her Majesty’s Government what new help they are considering for people with haemophilia who were infected with hepatitis “C” by contaminated National Health Service blood products and for the dependants of those who have since died; after debate, the question was answered by the Lord Filkin.

The House was adjourned during pleasure.

The House was resumed.

14.  Police Reform Bill [HL]—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the House was resumed and the bill was reported with amendments; it was ordered that the bill be printed as amended. (HL Bill 64)

The House was adjourned at twenty-eight minutes past ten o’clock

till tomorrow, half-past two o’clock.
