MINUTES OF PROCEEDINGS

The House met at eleven o’clock.

PRAYERS were read by the Lord Bishop of St. Edmundsbury and Ipswich.

1.  Barony of Herbert—The Lord Chancellor reported that Her Majesty had been pleased to determine the abeyance in the Barony of Herbert, created by Writ in the year 1461, in favour of David John Seyfried; and that the provisions of Standing Order 10A had been complied with. The Clerk of the Parliaments was accordingly directed to enter Lord Herbert on the register of hereditary peers maintained under Standing Order 10 (5).

Judicial Business

2.  Central Sunderland Housing Company Limited (Respondents) v. Wilson (Petitioner)—The petition of Janette Wilson praying for leave to appeal was presented and referred to an Appeal Committee.

3.  Al-Fagih (Petitioner) v. HH Saudi Research & Marketing (UK) Limited (Respondents)—The petition of Saad Al-Fagih praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.

4.  Matthews (FC) (Appellant) v. Associated Portland Cement Manufacturers (1978) Limited and others (Respondents)—The appellant’s certificate of public funding was lodged.

5.  Union Discount Company Limited v. Zoller and others (Petitioners) and others (Respondents)—Upon application by the petitioners (the agents for the respondents not having entered an appearance), it was ordered that the petition be withdrawn and that there be no order as to costs.

6.  Command Paper—The following paper was presented to the House by command of Her Majesty and ordered to lie on the Table:

    Industrial Injuries—Report by the Industrial Injuries Advisory Council on Conditions due to Chemical Agents.      (5395)

7.  Affirmative Instruments—The following instruments were laid before the House for approval by resolution and ordered to lie on the Table:

    1.      Draft Tax Credits Up-rating Order 2002;

    2.      Draft National Assembly for Wales (Representation of the People) (Amendment) Order 2002.

8.  Negative Instrument—The following instrument was laid before the House and ordered to lie on the Table:

    Local Government (Best Value) Performance Plans and Reviews Amendment and Specified Dates Order 2002, laid under the Local Government Act 1999.      (305)

9.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Amendment List No. 4 to the Fifth Edition of The Queen’s Regulations for the Royal Air Force, laid under the Air Force (Constitution) Act 1917.

10.  Police Reform Bill [HL]—It was moved by the Lord Rooker that it be an instruction to the Committee of the Whole House to whom the Police Reform Bill has been committed that they consider the bill in the following order:

11.  Constitution Committee—It was moved by the Chairman of Committees, on behalf of the Committee of Selection, that the Lord Jauncey of Tullichettle be appointed a member of the Select Committee in the place of the Lord Weatherill; the motion was agreed to.

12.  Civil Defence (Grant) Bill—It was moved by the Lord Bassam of Brighton that the bill be now read a second time; after debate, the motion was agreed to and the Committee was negatived.

13.  British Overseas Territories Bill [HL]—The bill was returned from the Commons agreed to with amendments; it was ordered that the Commons amendments be printed. (HL Bill 55)

14.  Football (Disorder) (Amendment) Bill—The bill was read a third time and, after debate, passed and returned to the Commons with amendments.

15.  Northern Ireland Arms Decommissioning (Amendment) Bill—The report was received; an amendment was moved and (by leave of the House) withdrawn.

16.  Contracting Out (Functions in relation to Apsley House) Order 2002—It was moved by the Baroness Blackstone that the draft Order laid before the House on 23rd January be approved; after debate, the motion was agreed to.

17.  Air Navigation (Environmental Standards) Order 2002—It was moved by the Lord Filkin that the draft Order laid before the House on 17th January be approved; after debate, the motion was agreed to.

18.  Terrorism Act 2000 (Continuance of Part VII) Order 2002—It was moved by the Lord Privy Seal (Lord Williams of Mostyn) that the draft Order laid before the House on 31st January be approved; after debate, the motion was agreed to.

The House was adjourned at twenty minutes before two o’clock

to Monday, 25th February, half-past two o’clock except for judicial business.
