MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Derby.

1.  Lord Hannay of Chiswick—Sir David Hugh Alexander Hannay, GCMG, having been created Baron Hannay of Chiswick, of Bedford Park in the London Borough of Ealing, for life by Letters Patent dated 19th June 2001, was introduced between the Lord Bridges and the Lord Williamson of Horton, the Gentleman Usher of the Black Rod and Garter King of Arms preceding; and took and subscribed the oath pursuant to statute.

2.  Lord Sheldon—The Right Honourable Robert Edward Sheldon, having been created Baron Sheldon, of Ashton-under-Lyne in the County of Greater Manchester, for life by Letters Patent dated in the forenoon of 22nd June 2001, was introduced between the Lord Barnett and the Lord Dubbs, the Gentleman Usher of the Black Rod and Garter King of Arms preceding; and took and subscribed the oath pursuant to statute.

3.  Oaths—The Lords following took and subscribed the oath pursuant to statute:

Judicial Business

4.  On Demand Information plc (in administrative receivership) and others (Appellants) v. Michael Gerson (Finance) plc and others (Respondents) (England)—The appeal of On Demand Information plc and On Demand Information International plc was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 8th August next.

5.  Kibiti (FC) (Petitioner) v. Secretary of State for the Home Department (Respondent)—The petition of Romain Kibiti praying for leave to appeal was presented and referred to an Appeal Committee. The petitioner’s certificate of public funding was lodged (lodged 7th June).

6.  Omo-Etiobio (Petitioner) v. American Express Europe Limited (Respondents)—The petition of Fitzgerald Omo-Etiobio praying for leave to appeal was presented without payment of the fee, such fee having been waived by the Appeal Committee pursuant to Standing Order XIII; the said petition was referred to an Appeal Committee (lodged 15th February 1999).

7.  Lawrence (Respondent) v. Lesser (Appellant)—The appeal was set down for hearing and referred to an Appellate Committee.

8.  Appeal Committee—The following Order was made pursuant to the Second Report of the Appeal Committee appointed by the Lords of Appeal sitting in the name of the House of Lords by virtue of a Writing by Her Majesty The Queen under Her Majesty’s Sign Manual dated the 14th day of May last:

    Regina v. London Borough of Hammersmith and Fulham (Respondents) and others ex parte Burkett and another (FC) (Petitioners)—That the petition be referred for hearing.

9.  Appeal Committee—The following Order was made pursuant to the Third Report:

    Regina v. Jones (Petitioner)—That leave to appeal be given; and that the petition of appeal be lodged by 11th July next.

10.  Appeal Committee—The Fifth Report from the Appeal Committee was agreed to and the following Orders were made—

    Baird Textile Holdings Limited (Petitioners) v. Marks and Spencer plc (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Regina v. McAndrew-Bingham (Petitioner)—That leave to appeal be refused.

    DSG Retail Limited (Petitioners) v. Oxfordshire County Council (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 6.1(e); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Cerberus Software Limited (Petitioners) v. Rowley (Respondent)—That leave to appeal be refused; that the respondent be at liberty to apply for his costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Regina v. Pope (Respondent)—That the respondent be invited to lodge objections by 11th July next.

    Jones (Petitioner) v. Post Office (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Omo-Etiobio (Petitioner) v. American Express Europe Limited (Respondents)—That leave to appeal be refused.

    5.      Trunk Road Charging Schemes (Bridges and Tunnels) (England) Procedure Regulations 2001, laid under the Transport Act 2000.      (2303)

13.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.      Account of Receipts and Payments for 1999-2000 of the Commissioners of Customs and Excise in Account with the Government of the Isle of Man, laid under the Isle of Man Act 1979;

    2.      Report for 2001 of the Central Arbitration Committee, laid under the Employment Relations Act 1999;

    3.      (i)      Report for 2001 of the Parliamentary Ombudsman—

14.  House of Lords’ Offices—The First Report from the Select Committee was made; it was ordered that the Report be printed. (HL Paper 3)

15.  Barclays Group Reorganisation Bill [HL]—

16.  National Australia Group Europe Bill [HL]—

    The Chairman of Committees acquainted the House that pursuant to the resolution of 21st June the bills had been deposited in the office of the Clerk of the Parliaments together with the declarations of the agents; the bills were presented, read a first time, read a second time pro forma and committed to Unopposed Bill Committees.

Public Business

17.  Travel Concessions (Eligibility) Bill [HL]—A bill to amend the law relating to the age at which certain persons become eligible to receive travel concessions on journeys on public passenger transport services; and for connected purposes was presented by the Lord Falconer of Thoroton, read a first time and ordered to be printed. (HL Bill 5)

18.  Travel Concessions (Eligibility) Bill [HL]—It was ordered that the Explanatory Notes relating to the bill be printed. (HL Bill 5-EN)

19.  European Union (Implications of Withdrawal) Bill [HL]—A bill to establish a Committee of Inquiry into the implications of a withdrawal by the United Kingdom from the European Union was presented by the Lord Pearson of Rannoch, read a first time and ordered to be printed. (HL Bill 6)

20.  The Queen’s Speech—The debate on the motion that an Humble Address be presented to Her Majesty was resumed and, after further debate, was again adjourned till tomorrow.
