COMMENCEMENT

CLAUSE 171

127. Subsection (1) of clause 171 gives the appropriate authority power by order to appoint a day for bringing the Act in to force. Subsection 171(4) stipulates that the appropriate authority for Part 1 is the Lord Chancellor. For Part 2 or Schedule 13 the appropriate authority is the Secretary of State (for England) and the National Assembly for Wales (for Wales).

128. Subsection 171(2) provides for an order made under subsection 171(1) to contain such transitional provisions and savings as the appropriate authority sees fit. This allows a degree of flexibility in the implementation of the Act so that, for example, those who provide professional advice may make appropriate anticipatory arrangements prior to the Act coming into force.
