The House met at half-past two o’clock.

    PRAYERS were read by the Lord Bishop of Wakefield.

Judicial Business

1.  Royal Brompton Hospital National Health Service Trust v. Hammond and others (Appellants) and Taylor Woodrow Construction (Holdings) Limited (Respondents) (England)—The appeal of Watkins Gray International (UK) Limited, Ivor Gordon Berresford and Keith Pegden Smith was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 1st May next.

2.  Regina v. Commissioners of Customs and Excise (Respondents) ex parte Greater Manchester Police Authority (Petitioners)—The petition of the Greater Manchester Police Authority praying for leave to appeal was presented and referred to an Appeal Committee.

3.  Command Papers—The following papers were presented to the House by command of Her Majesty and ordered to lie on the Table:

4.  Affirmative Instrument—The following instrument was laid before the House for approval by resolution and ordered to lie on the Table:

5.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.      Community Legal Service (Funding) (Counsel in Family Proceedings) Order 2001, laid under the Access to Justice Act 1999;      (1077)

    2.      Import and Export Restrictions (Foot-and-Mouth Disease) (No.4) Regulations 2001, laid under the European Communities Act 1972;      (1080)

    7.      National Health Service (General Ophthalmic Services) Amendment Regulations 2001, laid under the National Health Service Act 1977.      (1084)

6.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Injuries in War (Shore Employments) Compensation (Amendment) Scheme 2001, laid under the Injuries in War Compensation Act 1914.

Select Committee Reports

7.  Delegated Powers and Deregulation—The following report from the Select Committee was made and ordered to be printed:

    15th Report, on the Health and Social Care Bill—Government response. (HL Paper 53)

8.  House of Lords’ Offices—The 2nd Report from the Select Committee was made; it was ordered that the Report be printed. (HL Paper 54)

9.  Statutory Instruments—The 11th Report from the Joint Committee was made on certain statutory instruments, including the following affirmative instruments:

      Limited Liability Partnerships (Fees) (No. 2) Regulations 2001;

      Draft General Commissioners of Income Tax (Costs) Regulations 2001;

      Draft Justices and Justices’ Clerks (Costs) Regulations 2001;

      Draft Local Authorities (Conduct of Referendums) (England) Regulations 2001;

      Draft Financial Services and Markets Act 2000 (Financial Promotion) Order 2001;

      Draft Local Authorities (Alternative Arrangements) (England) Regulations 2001;

    it was ordered that the Report be printed. (HL Paper 55)

Private Business

10.  Colchester Borough Council Bill [HL]—The bill was returned from the Commons agreed to.

Public Business

11.  Borough Freedom (Family Succession) Bill [HL]—A bill to make new provision relating to admission to borough freedom was presented by the Lord Mustill, read a first time and ordered to be printed. (HL Bill 37)

12.  Business of the House—It was moved by the Baroness Jay of Paddington that Standing Order 40 (Arrangement of the Order Paper) be dispensed with to allow the motion standing in the name of the Baroness Miller of Hendon to be taken before the Report stage of the Vehicles (Crime) Bill; the motion was agreed to.

13.  Business of the House—It was moved by the Baroness Jay of Paddington that, in the event of the Consolidated Fund (No. 2) Bill being brought from the Commons, Standing Order 46 (No two stages of a Bill to be taken on one day) be dispensed with tomorrow to allow the bill to be taken through its remaining stages that day; the motion was agreed to.

14.  International Criminal Court Bill [HL]—The bill was read a third time; amendments were disagreed to (see division lists 1 and 2); amendments were moved and (by leave of the House) withdrawn; a privilege amendment was agreed to; then, after debate, the bill was passed and sent to the Commons.

15.  Consolidated Fund (No. 2) Bill—A bill to authorise the use of resources for the service of the year ending on 31st March 2002 and to apply certain sums out of the Consolidated Fund to the service of the years ending on 31st March 2000, 2001 and 2002 was brought from the Commons endorsed with the certificate of the Speaker that the bill is a money bill, and read a first time.

16.  Weights and Measures (Metrication Amendments) Regulations 2001—It was moved by the Baroness Miller of Hendon that an Humble Address be presented to Her Majesty praying that the Regulations, laid before the House on 17th January, be annulled (S.I. 2001/85); after debate, the motion was disagreed to (see division list 3).

17.  Vehicles (Crime) Bill—The report was received; amendments were moved and (by leave of the House) withdrawn.

18.  Health and Social Care Bill—After debate, the House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the House was resumed after clause 23 stood part.

The House was adjourned at twenty minutes past eleven o’clock

till tomorrow, half-past two o’clock.
