MINUTES OF PROCEEDINGS

The House met at three o’clock.

    PRAYERS were read by the Lord Bishop of Southwark.

Judicial Business

1.  Regina v. Secretary of State for the Environment, Transport and the Regions (Appellant) ex parte Holding & Barnes Limited (Respondents) (On appeal from the Queen’s Bench Division of the High Court of Justice) (England)—The appeal of the Secretary of State for the Environment, Transport and the Regions was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 15th March next.

2.  Alconbury Developments Limited and others (Respondents) v. Secretary of State for the Environment, Transport and the Regions (Appellant) (On appeal from the Queen’s Bench Division of the High Court of Justice) (England)—The appeal of the Secretary of State for the Environment, Transport and the Regions was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 15th March next.

3.  Secretary of State for the Environment, Transport and the Regions (Appellant) v. Legal & General Assurance Society Limited (Respondents) (On appeal from the Queen’s Bench Division of the High Court of Justice) (England)—The appeal of the Secretary of State for the Environment, Transport and the Regions was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 15th March next.

4.  Ashworth Frazer Limited (Original Respondents and Cross-appellants) v. Gloucester City Council (Original Appellants and Cross-respondents) (England)—The cross-appeal of Ashworth Frazer Limited was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 15th March next.

5.  Kahn and another (Appellants) v. Commissioners of Inland Revenue (Respondents)—The appeal was set down for hearing and referred to an Appellate Committee (lodged 31st January).

6.  Appeal Committee—The following Orders were made pursuant to the 6th Report—

    Donohue (Respondent) v. Armco Inc and others (Petitioners)—That the petition be referred for hearing.

    AIB Group (UK) plc (formerly Allied Irish Banks plc and AIB Finance Limited) (Respondents) v. Martin and another (Petitioner)—That leave to appeal be given, and that the petition of appeal be lodged by 15th February next.

7.  Command Paper—The following paper was presented to the House by command of Her Majesty and ordered to lie on the Table:

    Foreign Affairs—Response of the Secretary of State for Foreign and Commonwealth Affairs to the Tenth Report from the Foreign Affairs Committee, Session 1999-2000, on China.      (5038)

8.  Affirmative Instruments—The following instruments were laid before the House for approval by resolution and ordered to lie on the Table:

    1.      Draft Transport Act 2000 (Designation of Transferee) Order 2001;

    2.      Pig Industry Restructuring (Capital Grant) Scheme 2001;      (251)

    3.      Draft Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 2001.

9.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

    1.      Northern Ireland Policing Board (Prescribed Period) Regulations 2001, laid under the Police (Northern Ireland) Act 2000;

    2.      Major Precepting Authorities (Excessive Budget Requirements—Payments) (England) Regulations 2001, laid under the Local Government Act 1999;      (219)

    3.      Pig Industry Restructuring (Non-Capital Grant) Scheme 2001, laid under the Farm Land and Rural Development Act 1988;      (252)

    4.      Local Authorities (Alteration of Requisite Calculations) (England) Regulations 2001, laid under the Local Government and Finance Act 1992.      (216)

Select Committee Report

10.  Tax Simplification Bills—The First Report from the Joint Committee, being a report on the Capital Allowances Bill, was made and ordered to be printed (together with the minutes of proceedings and the minutes of evidence). (HL Paper 24)

Public Business

11.  Social Security Fraud Bill [HL]—The House resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; the House was resumed.

12.  Passive smoking at work—The Lord Faulkner of Worcester asked Her Majesty’s Government when they will respond to the Health and Safety Commission’s draft Approved Code of Practice and Guidance on Passive Smoking at Work; after debate, the question was answered by the Lord Whitty.

13.  Social Security Fraud Bill [HL]—The House again resolved itself into a Committee upon the bill; amendments were agreed to; amendments were moved and (by leave of the Committee) withdrawn; the House was resumed after clause 1 stood part.

The House was adjourned at eleven minutes past eleven o’clock

to Monday next, half-past two o’clock.
