Magistrates' Courts Fees (Amendment) Order 2008 (S.I. 2008/117)

The Ministry of Justice submits this memorandum in response to the request dated 6 February 2008 on the point set out below:

What is the intended meaning of the expressions "LSC" and "the Funding Code" which appear in new paragraph 2(1)(a) in Schedule 2 to the Magistrates' Courts Fees Order 2005 (inserted by article 2 of this Order) and where are those expressions defined?.

The expression "LSC" means the Legal Services Commission established under section 1 of the Access to Justice Act 1999 and the expression "the Funding Code" means the code approved under section 9 of that Act. These definitions were omitted in error and will be included in the consolidated instrument currently being drafted by the Department.
