S.I. 2007/3133: memorandum from the Department for Environment, Food and Rural Affairs


Plant Health (England) (Amendment) (No. 3) Order 2007 (S.I. 2007/3133)


1.  The Committee has asked the Department for Environment, Food and Rural Affairs for a memorandum on the following point:

Given that this instrument appears to be limited to correction of errors in an earlier instrument (see Explanatory Memorandum, paragraphs 2 and 7), has the Department (in accordance with paragraph 3.4.11 of Statutory Instrument Practice) made arrangements for copies of this instrument to be made available free of charge to all known recipients of the earlier instrument? If not, explain why not. If so, explain why this instrument does not bear a headnote to that effect (see paragraph 3.4.14 of Statutory Instrument Practice).

2.  The Department has now arranged with HMSO for a refund to be made to known purchasers of the instrument; for the instrument to be issued free of charge to all future purchasers and all known purchasers of SI 2005/2530, and for a suitable headnote to be added to the instrument if the need to reprint it arises. The Department accepts that the instrument should have originally borne such a headnote.
