S.I. 2008/1097: memorandum from the Department for Environment, Food and Rural Affairs


Bathing Water Regulations 2008 (S.I. 2008/1097)


1.  The Committee has asked the Department for Environment, Food and Rural Affairs for a memorandum on the following point:

Regulations 14 and 15 each refer several times to "relevant procedures for short-term pollution", an expression which is not defined in regulation 2. Regulation 2(1) instead defines "relevant measures for short-term pollution", which appears nowhere else in the instrument. Are both terms intended to cover the same concept? If so, which is the term intended by the Department?

2.  The term defined in regulation 2 should have been "relevant procedures for short-term pollution", as used in regulations 14 and 15. The Department regrets the error and will amend the instrument at the first opportunity.
