S.I. 2006/2967: memorandum from the Department for Work and Pensions

Housing Benefit and Council Tax Benefit (Amendment) (No. 2) Regulations 2006 (S.I. 2006/2967)

1.  In its letter to the Department of 6 December 2006, the Joint Committee requested a memorandum on the following points:

Explain the intended effect of regulations 2(3), 3(3), 4(3) and 5(3), given that the expression "designated office" appears in both paragraph (1) and paragraph (2) of the relevant regulation referred to.

2.  The Department's response to the Committee's point is outlined below.

3.   The Department acknowledges its error in this instrument. The amendment in paragraph (3) of regulations 2 to 5 should have been confined to the first paragraph of the regulations to be amended.

4.  The Department apologises for its error and undertakes to correct the defect at the earliest convenient opportunity.
