Mr. Prisk: The right hon. Lady is making an important point about transparency. Is the Minister categorically saying that this order is not part of a broader set of agreements with BAA?

Mr. McNulty: It will be part of a process between BAA and Uttlesford, as it was in May 2003 and when the section 106 agreement was agreed. Uttlesford agreed that, with the rise of ATM limits fully in mind, as is right and proper for a local planning authority. All that the order will do is to restore to Uttlesford in the first instance—I keep saying in the first instance to accommodate all that the hon. Member for Shrewsbury and Atcham said about appeals, inquiries and everything else subsequent in the planning process—the right to determine ATM limits.

I will not repeat all I have said about the ability of colleagues in Hertfordshire, Suffolk, Cambridge or elsewhere in the immediate area to have an input into the process. They should not have a seat at the table or a vote on the planning committee; that would be entirely wrong. However, those in close proximity to Uttlesford should certainly have their say, and if they are not, East Hertfordshire council, Braintree council and others will be failing their local communities and in part failing their local MPs.

When I was on a planning committee, we had substantive debates about a supermarket on the other side of the road and ensuring that proper diligence was

given to the concerns of my borough even though we were not in the first instance the planning authority concerned. I have seen such debates right through to the inquiry stage, if we felt that the borough next door did not take due cognisance or give full weight to our concerns. That happens on a Labour-to-Labour and a Tory-to-Tory basis; it is what prevails in local communities.

Given that we want to restore the ability to set flight limitation locally, I finally commend the order to the Committee.
