Provide for a scheme for the registration and licensing of houses in multiple occupation; to require certain matters relating to energy efficiency to be included in such a scheme; and for connected purposes.
BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Houses in multiple occupation: registration and licensing scheme.     1. - (1) The Secretary of State, shall, within twelve months of the passing of this Act, make regulations-

(a) prescribing the nature of schemes for the registration and licensing of houses in multiple occupation; and

(b) requiring each housing authority to prepare and implement such a scheme in their area.

    (2) The regulations shall, in particular, provide that schemes shall require owners or landlords of houses in multiple occupation, as a condition of registration and licensing,-

(a) to maintain the premises to a satisfactory standard, by measures including-

(i) the provision of a standard of energy efficiency in the premises as prescribed by the housing authority;

(ii) the carrying out of such improvements in respect of energy efficiency as the housing authority may prescribe within such a period as the authority may prescribe; and

(iii) the provision of an approved energy rating to every tenant in the property; and

(b) to establish and maintain a tenancy management scheme.

    (3) The regulations-

(a) shall define the meaning of "approved energy rating"; and

(b) may make such incidental, supplementary or consequential provision as the Secretary of State considers expedient.

    (4) Regulations made under this section shall be subject to annulment in pursuance of a resolution of either House of Parliament.

    (5) In this section-

"house in multiple occupation" has the meaning given by the Energy Conservation Act 1996;

"tenancy management scheme" means a scheme setting minimum standards for the management and occupation of a house in multiple occupation.

Financial provisions.     2. There shall be paid out of money provided by Parliament-

(a) any expenditure incurred by the Secretary of State in consequence of this Act; and

(b) any increase attributable to this Act in the sums payable out of money so provided by virtue of any other Act.

Short title and extent.     3. - (1) This Act may be cited as the Houses in Multiple Occupation (Registration Scheme) Act 2001.

    (2) This Act extends to England and Wales only.
